Front & Rear Yard Setback Variance 108 Lee Avenue Petitioner: Central AR Home Builders LLC Representative: Tucker Land Surveying 6-7 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: August 12, 2024 6:16 p.m. – 6:25 p.m. ATTENDANCE: Commissioners: Dietz, Montgomery, Ruple, Twitty, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Oakley declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Montgomery moved, seconded by Council Member Dietz to approve the regularly scheduled meeting minutes of May 13, 2024. MOTION CARRIED. VARIANCE(S): a. Front Yard Setback Variance 171 Roosevelt Road The public hearing opened at approximately 6:16 p.m. Representative Nick Tucker with Tucker Land Surveying stated his client bought this vacant lot from the City and would like to build a single-family house in the Sunnyside Addition neighborhood. He explained during the survey they discovered a sewer line running across a portion of the lot, which is pushing the house into one of the setbacks, so they are requesting a variance. The public hearing closed at approximately 6:17 p.m. Council Member Dietz moved, seconded by Commissioner Twitty to approve a 17.5’ front yard setback at 171 Roosevelt Road. MOTION CARRIED. b. Rear Yard Setback Variance 103 Cross Street The public hearing opened at approximately 6:17 p.m. Mr. Tucker confirmed this is the same client and floor plan. He stated during the survey, they found a sewer line traversing the lot. He explained this is the old Air Base neighborhood, so they put the sewer wherever they wanted to. He noted they are honoring the 15’ total easement, 7.5’ on both sides, requested by Wastewater, but are requesting a rear yard setback variance. The public hearing closed at approximately 6:18 p.m. Commissioner Montgomery moved, seconded by Council Member Dietz to approve a 20’ rear yard setback at 103 Cross Street. MOTION CARRIED. c. Front & Rear Yard Setback Variance 108 Lee Avenue The public hearing opened at approximately 6:19 p.m. Mr. Tucker confirmed this is the same client and neighborhood, but this is a small, corner lot that has two 25’ front setbacks. He explained with the required setbacks, the lot is virtually unbuildable, so they are requesting setback variances for fronts and rear in order to situate a single-family house. He pointed out they are requesting 10’ on one side, noting they have even moved the driveway to the side, but the lot is very narrow for the floor plan. He mentioned they had to shift the house to the south to get across the sewer line. BOARD OF ADJUSTMENT REGULAR MEETING August 12, 2024 6:16 p.m. – 6:25 p.m. Chairman Oakley shared his traffic visibility concerns since it faces two streets on a corner lot with a porch 6.5’ from the sidewalk. Mr. Tucker brought up that if you turn the house the other way on the plot plan, it is the same, putting it roughly 10.5’-11’ off the other front as well. He stated the best that Wastewater knows, all of the sewer lines are active and cannot be moved without significant costs. City Engineer Adam Whitlow related that his office had a small concern, but noted this is not completely uncommon with what they have done with other lots. He is not opposed to it necessarily, but does have concerns. He mentioned a 25’ visibility triangle and confirmed the water lines are on the opposite side of the road, so they are good with them. Mr. Tucker explained that the road going from north to south would have a stop sign, so traffic would be stopping in front of the house before they could proceed and turn right. He concurred that it would somewhat impair the vision, but it is a city street with not a lot of people speeding through, from what he has seen. Council Member Dietz did not think it would be an issue and was happy to see someone building new properties in Jacksonville. The public hearing closed at approximately 6:25 p.m. Council Member Dietz moved, seconded by Commissioner Montgomery to approve a 20’ front yard setback along Jaxon Street, a 10.75’ front yard setback along Lee Avenue, and a 5’ rear yard setback at 108 Lee Avenue. MOTION CARRIED. ADJOURNMENT: Without objection, Chairman Oakley adjourned the meeting at approximately 6:25 p.m. MOTION CARRIED.
