APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting of April 8, 2024 1 3. VARIANCE REQUEST(S): Side Yard & Front Yard Setback 300 Hickory Street Petitioner: Tesell Smith 2-3 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 13, 2024 6:00 p.m. – 6:11 p.m. ATTENDANCE: Commissioners: Dietz, Montgomery, Ruple, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Oakley declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Montgomery moved, seconded by Commissioner Ruple to approve the regularly scheduled meeting minutes of April 8, 2024. MOTION CARRIED. VARIANCE(S): Side Yard & Front Yard Setback 300 Hickory Street The public hearing opened at approximately 6:00 p.m. Petitioner Tesell Smith stated he has a house plan that will need a variance for the side and front yard setbacks in order to fit. City Engineer Adam Whitlow clarified the 35’ front yard setback does not require a variance. He noted the only variance needing considered is a 10.4’ side yard setback off Gray Street, instead of 25’. He confirmed they received two calls regarding the request, but neither were objections. He pointed out that the right-of-way on Hickory Street is 60’ wide, when they are normally 50’ wide, so there is already an additional 5’ of green space on that side you would not normally have. He mentioned the original structure encroached the front setback by being 16’. Chairman Oakley shared that he measured the property and it does not look like there will be a sight problem. Engineer Whitlow related there is a privacy fence on the north and a chain-link fence on the west of the lot now. He stated it will be a new build and is certain it will be nice. Chairman Oakley mentioned there can be no structures or fence in the right-of-way. Engineer Whitlow confirmed they will evaluate Mr. Smith’s plans at the building permit stage. The public hearing closed at approximately 6:10 p.m. Commissioner Ruple moved, seconded by Commissioner Montgomery to approve a 10.4’ side yard setback at 300 Hickory Street. MOTION CARRIED.
