Jacksonville Sub. #1 Lot 40 and north ½ alley Petitioner: Sullivan Investment Properties Representative: Bond Engineering 4-5 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: April 8, 2024 6:11 p.m. – 6:15 p.m. ATTENDANCE: Commissioners: Dietz, Twitty, Ruple, and Chairman Oakley were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Acting Chairman Moore declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Twitty moved, seconded by Commissioner Ruple to approve the regularly scheduled meeting minutes of March 11, 2024. MOTION CARRIED. VARIANCE(S): Side Yard Setback Variance, W. Jacksonville Sub. #1, Lot 40 and north ½ alley The public hearing opened at approximately 6:11 p.m. City Engineer Adam Whitlow stated this is one of the small, 50’ wide lots and what they are proposing is pretty standard. He explained this is not one of the subdivisions where we have a standing platted side setback, so the code refers to two frontage setbacks, which mean 25’ and 25’, but it is almost impossible on a 50’ lot. He told how his department has requested at least a 15’ side setback and they complied, so Staff supports the variance request. When Chairman Oakley inquired about fencing, he replied that visibility issues are in a separate part of code. He told how City fencing issues will be addressed this quarter. The public hearing closed at approximately 6:15 p.m. Council Member Dietz moved, seconded by Commissioner Ruple to approve a 15’ side yard setback at Lot 40 and north ½ alley of West Jacksonville Subdivision #1. MOTION CARRIED. ADJOURNMENT: Without objection, Acting Chairman Moore adjourned the meeting at approximately 6:15 p.m. MOTION CARRIED.
