A RESOLUTION AUTHORIZING THE CITY OF
JACKSONVILLE TO RENEW THE CONTRACT OF
OBLIGATION WITH THE ARKANSAS DEPARTMENT OF
ENVIRONMENTAL QUALITY, AMENDING RESOLUTION NO.
840 (#09-2023); AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, entered into a Contract of
Obligation with the Arkansas Department of Environmental Quality as authorized
under ACA § 8-6-1603, as part of the City's submission for a Solid Waste Disposal
Facility permit in 2013. Due to the City's permit renewal and closure cost increase,
the City deems it necessary and proper to renew the Contract of Obligation with the
Arkansas Department of Environmental Quality,
WHEREAS, on November 2, 2023, Jacksonville City Council authorized the
Mayor and City Clerk to enter into the Contract of Obligation on behalf of the City
for an amount not exceed Twenty -Five Thousand Five Hundred Ninety-five Dollars
($25,595.00), and
WHEREAS, the Arkansas Division of Environmental Quality has
subsequently informed the City that an amended amount, not to exceed Thirty -Eight
Thousand Three Hundred Ninety-three Dollars ($38,393.00), would be necessary for
the permit issuance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk are hereby authorized to
enter into the Contract of Obligation affixed hereto and to sign the Contract of
Obligation on behalf of the City of Jacksonville, Arkansas for its Solid Waste
Disposal Facility. Said Contract of Obligation shall not exceed the amount of Thirty -
Eight Thousand Three Hundred Ninety-three Dollars ($38,393.00), which will cover
the costs associated with enclosure of the yard waste compost area.
SECTION TWO: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect from
and after its date of passage.
