Side Yard Setback Variance 304 Forest Oak Drive Petitioners: John & Kelly Scarborough 4 (information included in packet) ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 8, 2023 6:00 p.m. – 6:09 p.m. ATTENDANCE: Commissioners: Dietz, Ruple, Twitty, and Chairman Brown were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brown declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Ruple moved, seconded by Commissioner Twitty to approve the regularly scheduled meeting minutes of February 13, 2023. MOTION CARRIED. VARIANCE(S): a. Rear Yard Setback Variance 1114 Grazing Lane Chairman Brown opened the public hearing at approximately 6:01 p.m. Petitioner Ted Grove stated he is adding an approximately 500 square foot additional to the back of his house that extends further back than the 25-foot setback required. He explained the extension will be like a cottage for his father-in-law who is getting older and will need help soon. He detailed that it will be about 25 feet wide and 24-25 feet deep with a breezeway and two rooms. He noted it is 15 feet away from the next building, which is basically on the property line behind. City Engineer Adam Whitlow and City Clerk Susan Davitt confirmed their offices have not received any calls regarding this request. Engineer Whitlow shared the Staff report relating that the request is for a setback variance of 12 feet from 25, it is a platted subdivision, it adheres to the Bill of Assurance, the finish will match the existing exterior, the storage building shown on the plot plan has to be removed, and the rear yard coverage is 22%, considering a 600 square foot room addition. He pointed out that Staff sees no adverse impact to the request. Mr. Grove described his home as being brick, assuring they will try to match it as close as they can. He mentioned a porch, a slab being lifted to house level, and French doors instead of sliding ones. Chairman Brown closed the public hearing at approximately 6:05 p.m. Council Member Dietz moved, seconded by Commissioner Ruple to approve a 12 feet rear yard setback for 1114 Grazing Lane. MOTION CARRIED. b. Side Yard Setback Variance 304 Forest Oak Drive Chairman Brown opened the public hearing at approximately 6:06 p.m. Kelly Scarborough stated she put in a pool a few years ago and when they did, she was going by her survey, noting that she has a 7.5-foot easement on two sides of her yard. She explained how she centered the pool to her house, and if she realized there was a right-of-way easement on the other side of the yard, she would not have centered it, in order to leave room for a kitchen. She confirmed they want to put in an outdoor kitchen that will match their Bill of Assurance and their home. She related there will not be any brick, but there will be rock. She mentioned having composite BOARD OF ADJUSTMENT REGULAR MEETING May 8, 2023 6:00 p.m. – 6:09 p.m. decking so if there was ever a problem, it could be removed fairly easily. She assured she does not want to be a problem to her neighbors, so she wants to do it neat and right. She brought up that it will be gazebo-type with a rock fireplace, rock on the bottom part of the cedar posts, composite decking, have an architectural shingle roof, and gutters. City Engineer Adam Whitlow and City Clerk Susan Davitt confirmed their offices have not received any calls regarding this request. Chairman Brown closed the public hearing at approximately 6:09 p.m. Council Member Dietz moved, seconded by Commissioner Twitty to approve a 2 feet side yard setback at 304 Forest Oak Drive. MOTION CARRIED. ADJOURNMENT: Without objection, Chairman Brown adjourned the meeting at approximately 6:09 p.m. MOTION CARRIED.
