VANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS TO THE
PARK PICNIC TABLES, FOUL POLES, AND TRASHCANS FOR
SUSTAINED DURING THE TORNADO ON MARCH 31, 2023; FOR
IATE IMPLEMENTATION AND ACCESS FOR DEPARTMENT AND
F JACKSONVILLE REPRESENTATIVES; DECLARING AN
vCY; AND, FOR OTHER PURPOSES.
WE EREAS, Dupree Park, located within the jurisdiction of the City of Jacksonville,
has sufferec substantial damages as a result of the tornado that occurred on March 31, 2023;
and
w E+ KN;AS, repairs to Dupree Park are necessary to restore it to a safe and
functional condition for the benefit and enjoyment of the community; and
WHEREAS, the repairs required for Dupree Park are urgent and time -sensitive due
to the impact on public safety and the need to resume regular park operations promptly; and
WHEREAS, the City has insurance coverage that will cover the costs associated
with the rep airs to Dupree Park; and
WH EREAS, The City will submit the necessary documentation and claims to the
insurance cc mpany to ensure reimbursement for the costs associated with the repairs.
WHEREAS, the City, in its best efforts to secure the lowest possible price, has
obtained qu tes, the lowest of which is presented herein; and
WH 'REAS, the Jacksonville Parks and Recreation Department asks City Council to
waive competitive bidding and request they be allowed to contract with BSN Sports.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL DF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SEC ION ONE: Competitive bidding for Dupree Park picnic tables, foul poles,
and trashca s by the Jacksonville Parks and Recreation Department would be untimely,
making said competitive bidding unfeasible and impractical.

CION TWO: Competitive bidding is hereby waived, pursuant to ACA § 14-

Parks and Recreation Department. Authorization is hereby given to the Mayor

SE TION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by sad Council in conflict herewith are hereby repealed to the extent of such conflict.
SE 'TION FOUR: This Ordinance, necessary for the continued efficient delivery
of public services and for the benefit, health, safety, and welfare of the citizens of
Jacksonvill , should be implemented immediately. Therefore, an emergency is hereby
declared, aild this Ordinance shall be in force and effect from and after its date of passage.
