vANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS TO THE
PARK LIGHTING FOR DAMAGE SUSTAINED DURING THE

NTATIVES; DECLARING AN EMERGENCY; AND, FOR OTHER

WHEREAS, Dupree Park, located within the jurisdiction of the City of Jacksonville,
has suffered substantial damages as a result of the tornado that occurred on March 31, 2023;
and
w 1+ HEAS, repairs to Dupree Park are necessary to restore it to a safe and
functional ondition for the benefit and enjoyment of the community; and
WE EREAS, the repairs required for Dupree Park are urgent and time -sensitive due
to the impact on public safety and the need to resume regular park operations promptly; and
WHEREAS, the City has insurance coverage that will cover the costs associated
with the repairs to Dupree Park; and
WH REAS, The City will submit the necessary documentation and claims to the
insurance company to ensure reimbursement for the costs associated with the repairs.
WHEREAS, the City, in its best efforts to secure the lowest possible price, has
obtained quotes, the lowest of which is presented herein; and
WHEREAS, the Jacksonville Parks and Recreation Department asks City Council to
waive competitive bidding and request they be allowed to contract with Musco Sports
Lighting, LEC.
NO� THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL F THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SEC ION ONE: Competitive bidding for Dupree Park lighting by the
Jacksonville Parks and Recreation Department would be untimely, making said competitive
bidding unfeasible and impractical.
SEC ION TWO: Competitive bidding is hereby waived, pursuant to ACA § 14-
58-303, to authorize contracting for Dupree Park lighting for the Jacksonville Parks and
Recreation Department. Authorization is hereby given to the Mayor and/or his authorized
representative(s) to enter into contract with Musco Sports Lighting, LLC not to exceed Six
Hundred On Thousand Five Hundred Dollars ($601,500), plus any applicable taxes.

SE'd TION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by s Council in conflict herewith are hereby repealed to the extent of such conflict.
SE 'TION FOUR: This Ordinance, necessary for the continued efficient delivery
of public services and for the benefit, health, safety, and welfare of the citizens of
Jacksonville, should be implemented immediately. Therefore, an emergency is hereby
declared, and this Ordinance shall be in force and effect from and after its date of passage.
