1732AN ORDI DUPREE TORNADi ACCESS REPRESS PURPOSE ORDINANCE NO. 1732 (#16 - 2023) vANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS TO THE PARK BLEACHERS FOR DAMAGE SUSTAINED DURING THE ON MARCH 31,2023; FOR APPROPRIATE IMPLEMENTATION AND FOR DEPARTMENT AND CITY OF JACKSONVILLE NTATIVES; DECLARING AN EMERGENCY; AND, FOR OTHER S. WE EREAS, Dupree Park, located within the jurisdiction of the City of Jacksonville, has sufferec substantial damages as a result of the tornado that occurred on March 31, 2023; and w EKLAS, repairs to Dupree Park are necessary to restore it to a safe and functional condition for the benefit and enjoyment of the community; and WHEREAS, the repairs required for Dupree Park are urgent and time -sensitive due to the impact on public safety and the need to resume regular park operations promptly; and WHEREAS, the City has insurance coverage that will cover the costs associated with the repairs to Dupree Park; and WH REAS, The City will submit the necessary documentation and claims to the insurance cc mpany to ensure reimbursement for the costs associated with the repairs. WHEREAS, the City, in its best efforts to secure the lowest possible price, has obtained qu tes, the lowest of which is presented herein; and WH REAS, the Jacksonville Parks and Recreation Department asks City Council to waive comy etitive bidding and request they be allowed to contract with Cunningham Recreation. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SEC ION ONE: Competitive bidding for bleacher repairs by the Jacksonville Parks and creation Department would be untimely, making said competitive bidding unfeasible a4d impractical. SE 58-303, to and Recre authorized One Hund applicable ON TWO: Competitive bidding is hereby waived, pursuant to ACA § 14- orize contracting for Dupree Park bleacher repairs for the Jacksonville Parks 1 Department. Authorization is hereby given to the Mayor and/or his esentative(s) to enter into contract with Cunningham Recreation not to exceed Fifty -Two Thousand Six Hundred Ten Dollars ($152,610.00), plus any s and freight charges. ORDINANCE NO. 1732 (416 - 2023) Page Two SECTION THREE: All Ordinances, parts of Ordinances, or previous actions taken by said Council in conflict herewith are hereby repealed to the extent of such conflict. SE TION FOUR: This Ordinance, necessary for the continued efficient delivery of public services and for the benefit, health, safety, and welfare of the citizens of Jacksonville,should be implemented immediately.
