AN ORDI ANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS TO THE
DUPREE PARK SCOREBOARD FOR DAMAGE SUSTAINED DURING THE
TORNADO ON MARCH 31,2023; FOR APPROPRIATE IMPLEMENTATION AND
ACCESS FOR DEPARTMENT AND CITY OF JACKSONVILLE
REPRES TATIVES; DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES.
W EREAS, Dupree Park, located within the jurisdiction of the City of Jacksonville,
has sufferesubstantial damages as a result of the tornado that occurred on March 31, 2023;
and
WHEKLAS, repairs to Dupree Park are necessary to restore it to a safe and
functional c ndition for the benefit and enjoyment of the community; and
WHEREAS, the repairs required for Dupree Park are urgent and time -sensitive due
to the impac on public safety and the need to resume regular park operations promptly; and
WHREAS, the City has insurance coverage that will cover the costs associated
with the rep�irs to Dupree Park; and
WH REAS, The City will submit the necessary documentation and claims to the
insurance cc mpany to ensure reimbursement for the costs associated with the repairs.
WHEREAS, the City, in its best efforts to secure the lowest possible price, has
obtained quotes, the lowest of which is presented herein; and
WHEREAS, the Jacksonville Parks and Recreation Department asks City Council to
waive comptitive bidding and request they be allowed to contract with Rainey Electronics,
Inc.
NOTHEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL F THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for scoreboard repairs by the Jacksonville
Parks and R creation Department would be untimely, making said competitive bidding
unfeasible and impractical.

ON TWO: Competitive bidding is hereby waived, pursuant to ACA § 14-
iorize contracting for Dupree Park scoreboard repairs for the Jacksonville
•eation Department. Authorization is hereby given to the Mayor and/or his
esentative(s) to enter into contract with Rainey Electronics, Inc. not to exceed
usand Two Hundred Three Dollars ($36,203.00), plus any applicable taxes.

SECTION THREE: All Ordinances, parts of Ordinances,
taken by sad Council in conflict herewith are hereby repealed to the extent of such conflict.
SECTION FOUR: This Ordinance, necessary for the continued efficient delivery
of public services and for the benefit, health, safety, and welfare of the citizens of
Jacksonville, should be implemented immediately. Therefore, an emergency is hereby
declared, and this Ordinance shall be in force and effect from and after its date of passage.
