JACKSONVILLE, ARKANSAS, IN TIE EXECUTION OF
A RIGHT -OF -WAY AND EASEMENT TO ARKANSAS
POWER & LIGHT COMPANY, GRANTING ARKANSAS
POWER & LIGHT COMPANY AUTHORITY TO CONSTRUCT
AND MAINTAIN ELECTRIC FACILITIES UN THE LANDS
BELONGING Tu THE CITY OF JACKSONVILLE,
ARKANSAS TO SERVE HIWASSW MANUFACTURING
COMPANY, INC.
WHEREAS, Arkansas Power & Light Company desires to install, operate
and maintain overhead distribution lines, surface mounted transformers and other
related electric facilities under and across certain lands belonging to the
City of Jacksonville, Arkansas, for the purpose of supplying Hiwesse Maimfacturing
Company, Inc. electric service in the City of Jacksonville; and
GG WHEREAS, The City of Jacksonville will benefit from the granting
• of such right -of -way by reason of improved services to its residents and
others; and
WHEREAS, Arkansas Power & Light Company is willing to pay the sum
of One Dollas (01.00) for and in consideration of said easements, with the
rights and privileges contained in an easement and right -of -way, which
consideration is hereby found to be a fair and just compensation
NOW, THEREFORE, BE IT RESOLVED by THE MAYOR OF THE CITY OF
JACKSONVUJ.E, ARKANSAS:
SECTION 1. The Mayor and City Clerk of the City of Jacksonville
are hereby authorized and directed to execute an easement and right -of -way
running in favor of Arkansas Power & Light Company for the consideration of
One Dollar ($1.00), which easement and right -of -way is in form and su:'stance
as follows:

KNOW ALL MEN BY tHESE PRESENTS:
THAT 01'?! OF JACKSONVILLE, ARKANSAS, cy its Mayor, authorized by
Resolution No. 98 -68, on this 7th day of March, 19bts, hereinafter referred to
as Grantor, for and in consideration of the sum of ONE DOLLP.R($1.00) and other
valuable considerations paid by Arkansas Power & Light Company, and the receipt
of which is acknowledged, hereby grants and conveys unto the said Arkansas
Power & Light Company, and unto its successors and assigns, hereinafter
referred to as Grantee, the right, privilege, authority, easement and right-
of-way to build, rebuild, remove, renew, maintain, and operate upon, over, across
and underneath the easement and right -of -way hereinafter described, overhead
circuits, conductors, poles, fixtures, guys and anchors and other necessary
equipment and facilities for the purposes of transmitting and distributing
electric current and supplying electric services. The rights hereby conferred
provide for the privilege and authority to enter upon the said easement and
right -of -way at any and all tines for the purposes herein set forth, and the
further right to maintain adequate sufficient and required clearances between
the electric circuits, facilities and equipment and other objects, growths and-
trees situated on the lanes of the Grantor. The easement and,ri;,ht -of -way
herein referred to is situated on the lands of the Grantor in Pulaski County,
Arkansas, and is described as follows, to -wit:
Part of the Northwest Quarter of Section. 2b,
Township 3 North, Range 11 West more particu-
larly described as foliowst
Starting at the Southwest corner of said
Section 24 thence East along the South line
of Section 24, 1,334'feet to a point in the
centerline of Barnes Road; thence N 0 30'
W along the centerline of Barnes Read 2045
feet to the point 1 3' from the main building;
thence N 0 30' W a distance of 224 feet;
thence S Be 34' E a distance of 570' to the
centerline of Barnes Road; thence S 0 30'
• E a distance of 24 feet to the point of
beginning. The easement being a strip of
land 24 feet wide.
Under the same terms and conditions as set forth in this
easement and right -of -way, Southwestern ;ell Telephone Company may own
and erect the pole line for the joint use of both companies, and the Grantee
may permit the use of its pole line by the Telephone Company.
SECTION 2. The authority and duty es tablished in Section 1
hereof in connection with the execution of said right-of-m-7 permit is
and shall be subject to the approval of the City Attorney, who shall
determine whether or not the execution of said eeserent and right -of -way
is in proper form.
SECTION 3. This resolution shall be in full force and effect
from and after its adoption.
