REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE
The City Council of the City of Jacksonville, Arkansas met in a regular
session on October 20, 2022 at the regular meeting place of the City Council.
Council Member Bolden delivered the invocation and Mayor Johnson led a
standing audience in the “Pledge of Allegiance” to the flag.
ROLL CALL: City Council Members: Dietz, Bolden, Blevins, Sansing, Ray, Traylor,
Twitty, Smith, and Rains answered ROLL CALL. Mayor Johnson also answered ROLL
CALL declaring a quorum. PRESENT NINE (9) ABSENT (1). Council Member Mashburn
was absent.
Others present for the meeting were: City Attorney Stephanie Friedman,
Finance Director Cheryl Erkel, Fire Chief Alan Laughy, City Engineer Adam
Whitlow, Lieutenant Ryan Wright, IT Director Emily Osment, Jeff Elmore, Wyatt
Elmore, and Chase Walker.
PRESENTATION OF MINUTES: Mayor Johnson presented the minutes of the regularly
scheduled City Council meeting of October 6, 2022 for approval and/or
correction at the next regularly scheduled City Council meeting.
APPROVAL AND/OR CORRECTION OF MINUTES:
Council Member Bolden moved, seconded by Council Member Ray that the minutes
of the regularly scheduled City Council meeting of September 15, 2022 be
APPROVED. MOTION CARRIED.
CONSENT AGENDA: REGULAR MONTHLY REPORT/FIRE DEPARTMENT
Council Member Bolden moved, seconded by Council Member Ray to approve the
regular monthly report for September 2022 from the Jacksonville Fire Department,
reflecting a fire loss of $83,500.00 and a savings total of $332,500.00.
REGULAR MONTHLY REPORT/POLICE DEPARTMENT
Council Member Bolden moved, seconded by Council Member Ray to approve the
Regular Monthly Report for September 2022 regarding annual crime statistical
comparisons.
REGULAR MONTHLY REPORT/CODE ENFORCEMENT
Council Member Bolden moved, seconded by Council Member Ray to approve the
regular monthly report as presented for September 2022.

GENERAL: a. ORDINANCE 1709 (#28-2022)
AN ORDINANCE AMENDING ORDINANCE NOS. 234, 402, 546, 1163, AND 1470; PROVIDING
RENEWAL OF A FRANCHISE AGREEMENT FOR CABLE COMMUNICATIONS SERVICES; PROVIDING
FOR COMPENSATION THROUGH A FRANCHISE FEE PAYABLE TO THE CITY; AND, FOR OTHER
PURPOSES.
Council Member Ray moved, seconded by Council Member Bolden to place
Ordinance 1709 on FIRST READING. ROLL CALL: Council Member Dietz, Bolden,
Blevins, Sansing, Ray, Traylor, Twitty, Smith, and Rains voted AYE. (0) voted
NAY. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of
Ordinance 1709.
Mayor Johnson stated this is a housekeeping measure they have to do when the
franchise agreement contract comes up for renewal. He explained that they are
at the maximum, they are paying it, and they are happy to be here. When
Council Member Traylor inquired if this agreement would keep anyone else from
providing service, he replied no, it just makes them pay a fee. He confirmed
that it is a pass-through fee to their customers.
Council Member Ray moved, seconded by Council Member Bolden to APPROVE
Ordinance 1709 on FIRST READING and SUSPEND THE RULES and place Ordinance
1709 on SECOND READING. ROLL CALL: Council Member Dietz, Bolden, Blevins,
Sansing, Ray, Traylor, Twitty, Smith, and Rains voted AYE. MOTION CARRIED.
Council Member Ray moved, seconded by Council Member Sansing to APPROVE
Ordinance 1709 on SECOND READING and SUSPEND THE RULES and place Ordinance
1709 on THIRD AND FINAL READING. ROLL CALL: Council Member Dietz, Bolden,
Blevins, Sansing, Ray, Traylor, Twitty, Smith, and Rains voted AYE. MOTION
CARRIED.
Council Member Bolden moved, seconded by Council Member Ray to APPROVE AND
ADOPT Ordinance 1709 in its entirety. ROLL CALL: Council Member Dietz,
Bolden, Blevins, Sansing, Ray, Traylor, Twitty, Smith, and Rains voted AYE.
MOTION CARRIED.

b. ORDINANCE 1708 (#27-2022)
AN ORDINANCE AMENDING JACKSONVILLE MUNICIPAL CODES § 8.01.078 (GRASS OR
WEEDS).
Mayor Johnson stated this item of business has been pulled by the sponsor.
c. DISCUSSION Rebsamen Medical Subdivision properties
Council Member Blevins recalled that during the last City Council meeting,
Units 2 & 3 were brought up again from a year and a half ago. He explained
that after looking more into it, there were some things that were said that
were not correct. He brought up that a year and a half ago there was an offer
for $290,000.00 that was approved, but there was an appraisal for
$475,000.00, which costed the City $2,000.00. He pointed out that a year and
a half later, the gentleman comes back with his own appraisal that went from
$450,000.00 to $202,000.00, adding that Mayor Johnson related that the reason
is because they did not originally take into account that it was for medical
use only. He shared that he contacted Larry Dupree, who has been an appraiser
for decades, and he said he 100% took all of that into consideration. He
mentioned the building this business was in was given away to Unity Health.
Mayor Johnson assured that the Hospital Board decided to do that, detailing
that they did not deal with public money and was a 501c3 private entity
governed by its Board, which he just happened to be on. He clarified that as
Chairman of that Board, he did not have any power to do anything.
Council Member Blevins stressed that he is just trying to figure out why the
City took an appraisal that came out of nowhere for a deal that was already
approved a year and a half ago and ended up selling the land for 40% of the
value that was given by the original appraiser that the City has used
forever.
Council Member Sansing moved, seconded by Council Member Bolden to end
discussion. MOTION CARRIED.

ANNOUNCEMENTS: 2023 Budget
When Council Member Twitty inquired about the 2023 Budget, Finance Director
Cheryl Erkel stated she is waiting on personnel salary information to put
stth
into a spreadsheet. She surmised the meetings should be held November 1-7,
assuring she will send out schedules to City Council and Press.
City Hall Lighting
Council Member Blevins mentioned after the last City Council meeting there
were a couple of people who tripped and fell because of how dark it was. He
asked if it were possible to get lights put outside by the front door because
someone could have gotten hurt. He believes they should get lights or keep
the lights on longer at the Police Department because it is very dark at
night there as well.

Council Member Twitty asked if there was a reason why they do not have lights
at the Police Department or out front of City Hall.
Mayor Johnson noted that he will look into it and have a talk with City
Engineer Adam Whitlow about it.

Senior Center Karaoke Night
Council Member Twitty reminded that the Senior Center Karaoke Night will be

held every 1 and 3 Friday of the month at 6:00 p.m.
ADJOURNMENT: Without objection, Mayor Johnson adjourned the meeting at
approximately 6:15 p.m. MOTION CARRIED.
