AN ORDINANCE AMENDING ORDINANCE 15369 MODIFYING
JACKSONVILLE MUNICIPAL CODE § 5.04.070 (PRIVILEGE LICENSE
DUE DATE AND DELINQUENCY PENALTIES); AND FOR OTHER
PURPOSES.
WHEREAS, City officials believe that businesses, corporations, entities, individuals,
institutions, partnerships, professionals, and/or sole proprietorships operating within the City of
Jacksonville should remain up-to-date in their remittance of drink tax, hotel/motel tax, and/or
prepared food tax; as such; said entities behind on tax obligations will no longer be able to renew
their annual business license to operate within the City. As a result, the City Council believes the
following amended provisions and additional requirements are necessary to update and amend the
Jacksonville Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: JMC § 5.04.070 (Privilege License Due Date and Delinquency Penalties) shall
be amended to read as follows:
A) All business, corporation, entity, individual, institution, partnership, professional,
and/or sole proprietorship operating within the City of Jacksonville shall pay in
advance on January 1St of every year for his/her/its annual Business Privilege License.
Failure to pay in full any balances due to the City later than February 1St of each year
will be classified as delinquent payments, subject to an Administrative Penalty Fee of
Fifty Dollars ($50.00) per delinquent License.
B) No annual License renewal shall be issued to any business, corporation, entity,
individual, institution, partnership, professional, and/or sole proprietorship with
outstanding balances under Jacksonville Municipal Codes §.§ 3.04 and/or 3.06 until any
outstanding balance has been remitted to the City.
C) Any business, corporation, entity, individual, institution, partnership, professional,
and/or sole proprietorship subject to payment requirements of this Code shall, upon
request by the City/City's agent(s), make available their accounting and business
records for review by the City for substantiation of amounts due under the provisions
of this Code.
SECTION TWO: All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed to the extent of such conflict.

SECTION THREE: This Ordinance shall take effect immediately upon passage and publication,
as provided by and subject to the requirements of applicable law.
