0822RESOLUTION NO. 822 (#07 - 2022) A RESOLUTION IN SUPPORT OF AND AUTHORIZING EXECUTION OF DOCUMENTS FROM THE CITY OF JACKSONVILLE TO EXCHANGE CERTAIN REAL PROPERTY DESCRIBED HEREIN (GENERAL LOCATIONS - 873 JANE DRIVE AND LOT 40 ON LENORA STREET IN EXCHANGE FOR 609 AND 611 GRAY STREET) AND, FOR OTHER PURPOSES. WHEREAS, the real property described on the attached Exhibit A is property owned by the City of Jacksonville; WHEREAS, the real property described on the attached Exhibit B is property owned by Win Knight Cabot Rentals, LLC; WHEREAS, because said City -owned property has received an acceptable Offer & Acceptance, it is in the City's best interests to exchange said real property described on the attached Exhibit A for the real property described on the attached Exhibit B, at no cost to either parry. As a result, certain City officials must be authorized to develop and execute the appropriate and required documents for the exchange of City -owned property to obtain 609 and 611 Gray Street, owned by Win Knight Cabot Rentals, LLC; and WHEREAS, the City of Jacksonville shall be responsible for the clean-up of Gray Street properties and advertisement for the rezoning request of 873 Jane Drive to be rezoned from R-1 to R- 2. The exchange of aforementioned properties shall be contingent upon the rezoning of 873 Jane Drive to R-2. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The Mayor and City Clerk of the City of Jacksonville, Arkansas, are hereby authorized to execute any and all documents to exchange the real property described in Exhibit A and Exhibit B. The Council hereby authorizes Mayor Johnson, City Clerk Davitt, and City Attorney Friedman to execute and complete the appropriate documents required to approve the exchange of the properties more particularly described in Exhibit A and Exhibit B between the City and Win Knight Cabot Rentals, LLC. i SECTION TWO: Any and all other Resolutions in conflict herewith are hereby repealed to the extent of said conflict.
