APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting of April 12, 2021 1 3. VARIANCE REQUEST(S): Rear Yard Setback Variance 207 South Redmond Road Petitioner: Preston Robinson 2 (aerial view & layout included in packet) ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: April 11, 2022 6:03 p.m. – 6:08 p.m. ATTENDANCE: Commissioners: Ruple, Montgomery, Dietz, Twitty, and Chairman Brown were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brown declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Montgomery moved, seconded by Council Member Dietz to approve the regularly scheduled meeting minutes of April 12, 2021. MOTION CARRIED. VARIANCE(S): Rear Yard Setback Variance 207 South Redmond Road Chairman Brown opened the public hearing at approximately 6:04 p.m. Chairman Brown stated that the normal setback is 25’ and the petitioner is requesting that he be allowed to basically eliminate the setback in order to extend three or four buildings to the property line. Petitioner Preston Robinson explained that the south property line currently has parking spaces for vehicles, small RVs, or trailers, and he would like to eliminate that and put in some buildings. He added because of the distant between the existing buildings and where the parking is, he needs that as a drive, therefore he is asking to eliminate the setback so he can put the buildings on the rear property line that backs up to the old aeriation pond for the Wastewater Treatment Plant, which he does not foresee will ever be used. He assured the Board that if you drove by and looked at it, you would see that it is just a space where deer run, so there is nothing back there and he cannot imagine anything would ever be built back there. He recalled that it was under EPA control at one time and may still be, but he feels no one would ever use it or buy that property if they are picky regarding the record. Commissioner Twitty noted that there is no residential out there, only rural land with an old pond. Mr. Robinson clarified that he believes the pond has been filled in, so there is nothing back there, but does not think anyone would ever do anything with it. He pointed out that Council Member Dietz is in the real estate business and he could not ever buy property like that because that would haunt him forever; no one would want to take title to it. Public Works Director Jim Oakley related that he and Engineering Tech Mylissa Griggs looked into this and agrees with what Mr. Robinson has said. He stated that the City of Jacksonville owns quite a bit of land back in there, it was under EPA restrictions to build on, and the City has no objection on this request. Chairman Brown closed the public hearing at approximately 6:08 p.m. Council Member Dietz moved, seconded by Commissioner Twitty to approve the rear yard setback variance for 207 South Redmond Road. MOTION CARRIED. BOARD OF ADJUSTMENT REGULAR MEETING April 11, 2022 6:03 p.m. – 6:08 p.m. ADJOURNMENT: Without objection, Chairman Brown adjourned the meeting at approximately 6:08 p.m. MOTION CARRIED.
