MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING

Chairman Brown were present.

Chairman Brown declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
VARIANCE(S): Parking Variances 8315 Hwy. 161
Chairman Brown opened the public hearing at approximately 6:03 p.m.
Representative Sebrina Ricks with Blew & Associates stated that she is one
of the representatives for the current property owner that Dollar General
is looking to purchase and develop. She explained that the site is located
at 8315 Highway 161 and currently consists of two tracts of 1.39 acres.
She related that they have applications for the final plat, site plan
review, and a conditional use permit on the agenda for tonight’s Planning
Commission meeting. She shared their plans to purchase this property and
develop it for a general merchandise retail store that is proposed to be
10,640 square feet. She stated that based on the current city requirement,
the site requires 106 parking spaces but that they are proposing 30 parking
spaces that include 2 handicap spots. She pointed out that the site is
irregular in shape toward the backside, lies in flood zone AE, and has a
base flood elevation of 250. She noted that they will have to develop the
site to where the top of the finished floor is 2’ above that base flood
elevation and, considering all of these things, they are requesting a
parking variance from the 106 required spaces to 30.
When Chairman Brown asked Engineering Tech Mylissa Griggs if any comments
were received, she replied that she has not received any negative comments.
She then explained that there is a section of our Code that allows one
parking space for every two hundred square feet, adding that it is typical
practice to allow 20% for retail storage. She explained that would take
the requirement down to 42 parking spaces without requesting a variance
so 42 to 30 is not as far off as it sounds at 106. She said that in looking
at similar stores, it is consistent that the two other Dollar Generals are
lower than Code requirements, one is at 54 and the other is at 40. She
confirmed that the City does not see any issues with this request.
Commissioner Montgomery asked Ms. Ricks if there would be a problem with
the gas lines around the area.
Ms. Ricks replied that they have been in contact with CenterPoint throughout
the project and they are okay with them tying in to the line at the front
of the property. Responding to a question from Commissioner Montgomery,
she answered that they will only have one entrance in and one out, but it
will include two lanes for exit and one coming in. She was unable to answer
when Commissioner Montgomery asked where the parking starts regarding how
far away from Highway 161.
Engineering Tech Mylissa Griggs offered that it is probably 40’ to 50’ and
pointing out they are putting in a lot of landscaping at the front of the
development.

Responding to a question from Commissioner Montgomery, Ms. Ricks stated
that as far as she knows, the speed limit will not change.
Chairman Brown closed the public hearing at approximately 6:11 p.m.
Commissioner Ruple moved, seconded by Commissioner Montgomery to approve
the parking variance request for 8315 Highway 161 Dollar General. MOTION
CARRIED.
ADJOURNMENT:
Without objection, Chairman Brown adjourned the meeting at approximately
6:12 p.m. MOTION CARRIED.
