1673ORDINANCE NO. 1673 (#23 — 2021)
AN ORDINANCE AMENDING AND MODIFYING § 6.04.010 (ANIMAL CONTROL) OF
THE JACKSONVILLE MUNICIPAL CODE; AND, FOR OTHER PURPOSES.
WHEREAS, it has come to the attention of City officials and Animal Control that some
citizens are using insufficient or inappropriate means to shelter animals outdoors. The lack of
adequate shelter is harmful to the animal, especially in the upcoming winter months.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: JMC § 6.04.010, paragraph S (Shelter) be and hereby is amended,
modified, and changed as indicated below:
Adequate shelter - provision of and access to shelter that is suitable for the species, age,
condition, size, and type of each animal; provides adequate space for each animal; is safe and
protects each animal from injury, rain, sleet, snow, hail, direct sunlight, the adverse effects of
heat or cold, physical suffering, and impairment of health; is properly cleaned; enables each
animal to be clean and dry, and, for dogs and cats, provides a solid surface, resting platform,
pad, floormat, or similar device that is large enough for the animal to lie on in a normal
manner and can be maintained in a sanitary manner. Under this chapter, shelters whose wire
(kennel or crate), tarp, grid, or slat floors: permit the animals' feet to pass through the
openings; sag under the animals' weight; or otherwise do not protect the animals' feet or toes
from injury are not adequate shelter.
SECTION TWO: All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION THREE: This Ordinance shall take effect immediately upon passage and
publication, as provided by and subject to the requirements of applicable law.
