OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on May 10, 2021. Chairman Stroud opened the meeting at approximately 6:30 p.m. expressing appreciation
to those in attendance. Chairman Stroud offered the invocation.
Chairman Stroud related that Engineering has been working on modifications to the conditional use codes for the various zones, noting that it would elevate the need to hear automatic
uses that are of a lesser nature than the zone currently requires. He stated that the Planning Commission would discuss the ramifications.
ROLL CALL: Commissioners Mike Dietz, William Montgomery, Billy Hall, Jim Moore, Vivian Brittenum, Jeff Twitty, Dan Brown, Greg Bollen, Chairman Mark Stroud were present and answered
ROLL CALL. Chairman Stroud declared a quorum. PRESENT (9) with Chair, ABSENT (0).
CORRECTION AND/OR APPROVAL OF MINUTES:
PUBLIC HEARING(S): REZONING 124 Dennis Lane from R-0 to R-6 Petitioner Lovell Family
Chairman Stroud noted that while it is admirable for the petitioner to request this rezoning to facilitate being close to aging parents, it is the Commission’s responsibility to look
at the factors regarding the land issue.
Chairman Stroud opened the public hearing at approximately 6:32 p.m.
Mr. Triston Lovell related that there have been three or four rezonings from R-0 to R-6 to accommodate single-wide trailers, explaining that he is looking to put in a double-wide that
would look like a home. He stated that they own the land and it has been vacant for quite a while. He related that they are going to clean up the lot and feel that it will serve the
street well.
Commissioner Moore clarified that the property is considered to be a metes and bounds and not two separate lots.
Mr. Lovell stated that the property consists of 220 feet along the street and 90’ is being proposed for the rezoning going toward Hwy. 161. He then answered Commissioner Moore that the
concrete slabs are further towards the roadway.
Commissioner Moore stated that his concern is that there are approximately seven other houses on the Street and only two or three mobile homes that look as if they have been there for
years.
Mr. Lovell noted that recently a family had moved in two additional mobile homes at the end of the Street.

Public Works Director Jim Oakley stated that an aerial photo shows the existing homes of the area, he confirmed with Mylissa Griggs that there is a manufactured home next door to this
property and it is zoned R-5. He then confirmed with Mr. Lovell that there was a mobile home on the lot previously that was torn down.
Mylissa Griggs then clarified that the property to the left is R-5 and the property to the right is R-0 and it is under the same ownership.
Chairman Stroud stated that there is R-0 around it so that is part of R-0 all around it. He stated that there is a spot issue where the R-5 is spot zoned but a rezoning to R-6 is a
spot zone.
Mylissa Griggs stated that her interpretation to spot zoning is when there is a commercial in the middle of residential, adding there is more leeway regarding having confined residential.
Chairman Stroud noted that a spot zone is just a zone in general. He then noted the zoning of C-1 as you turn onto the Street, which is just an open field.
Discussion ensued and Mylissa Griggs stated that she would further research the corner to determine if the entire corner or a small jag of the property is actually zoned C-1.
Public Works Director Jim Oakley noted that some of the property is owned by the City as a City park.
Chairman Stroud noted that the R-6 runs all the way up to the road but yet it is R-0 and yet inside the R-6 is a house. He stated that the area needs some zoning cleanup. He then noted
that there has been a lot of progress on the Street.
Council Member Dietz stated that a nice permanent double-wide would probably fit on the Street really well. He noted that the zoning is mixed and he stated that he feels it would be
a good fit. He added that he hates that it is a zoning issue.
Mr. Lovell stated that later he would be willing to have it put on a permanent foundation.
Chairman Stroud stated that it could be a condition for the approval of a conditional use that it be placed on a permanent foundation. He cited concerns for the rezoning being a permanent
change to the property. He noted the brick house, which is R-0 that is the base and what we are shooting for. He stated that he has noticed that on that side of town less trailers
and more houses are moving in and that is the trend. He issued concerns for spot zoning.
Commissioner Moore clarified that today’s mobile and manufactured housing has to meet HUD requirements.

Commissioner Moore stated that he agrees that an R-6 in mainly an R-0 zone is complicated for the future.
With no one to speak in opposition, Chairman Stroud closed the public hearing at approximately 6:48 p.m.
Commissioner Hall moved, seconded by Council Member Dietz to approve the rezoning of 124 Dennis Lane from R-0 to R-6. MOTION CARRIED with Commissioner Moore voting NAY.
b. CONDITIONAL USE 2607 T.P. White Drive C-2 use in a C-4 zone
Chairman Stroud opened the public hearing at approximately 6:49 p.m.
Mr. Barry Hoffman of Hoffman Architectural stated that he is representing Dr. Angela Gray who is requesting a conditional use to construct a new dental office on lot 4 of Madden Addition,
2607 T.P. White Drive which is currently zoned C-4.
Public Works Director Jim Oakley stated that the City does not have any objections and pointed out that this is an example of the amendments that are being proposed for the zoning ordinance.
In response to a question posed by Commissioner Montgomery, Ms. Griggs stated that this property is the vacant lot next to Bond Engineering on T.P. White Drive and a few hundred feet
south of the Billboard.
Commissioner Bollen moved, seconded by Commissioner Brittenum to approve the conditional use of C-2 for property located at 2607 T.P. White Drive. MOTION CARRIED.
Chairman Stroud closed the public hearing at approximately 6:51 p.m.
c. CONDITIONAL USE 205 Dupree Drive C-3 use in a C-2 zone
Chairman Stroud opened the public hearing at approximately 6:52 p.m.
Petitioners Timothy and Tonya Gibson related that they are requesting to open a mechanics shop. Mr. Gibson noted that his wife is proposing to open a cosmetology shop adjacent to the
mechanic shop, he explained that the building has a separation by a hallway.
Mr. Gibson answered Chairman Stroud that he feels this property would be a good location for a mechanics shop. He then noted that previously there was a car detail shop. He related
that he does a lot of work for Gwatney Chevrolet.
Chairman Stroud explained that the C-3 would be a more congested type of business than a normal C-2 operation.

Mr. Gibson noted that it is only a two-bay shop, saying that he would not have cars stacked on the property for service, adding that he would be the only person fixing cars. He stated
that he would not have any more than five cars there. He stated that he would have a tank on site for the disposal of oil and antifreeze. He noted that he is certified to perform
air conditioning work.
Chairman Stroud related that as a Commission they have the ability to issue conditions regarding a Conditional Use request.
Commissioner Dietz noted that when it was operated as a detail shop there was as many as eight cars on the lot and that was not unusual.
Mr. Gibson detailed his 30-year experience in the field as also a diesel mechanic, ensuring the Commission that he is familiar with the requirements to keep the shop clean and presentable.
He then assured the Commission that all mechanic work would be performed inside the shop. He noted that he has already purchased a lift. He then noted several other businesses that
he performs work for. He again answered that he would not have more than five or six cars at a time.
Chairman Stroud clarified that the two businesses would share the same parking lot, recalling that Mrs. Gibson is proposing to open a hair salon.
Mrs. Gibson clarified that she would be a one-chair salon.
Commissioner Brittenum stated that if the cars are kept to a minimum she does not feel there will be a congestion issue.
Council Member Dietz stated that the way the property is located, ten or twelve cars would not be a problem.
Commissioner Brittenum moved, seconded by Commissioner Montgomery to approve the conditional use of C-3 in a C-2 zone at 207 Dupree Drive stipulating a limit of no more than 10 cars.
MOTION CARRIED.
Chairman Stroud closed the public hearing at approximately 7:03 p.m.
REQUEST TO APPROVE PLAT(S):
BUILDING PERMIT(S):
GENERAL: It was the consensus of the Planning Commission to move forward with modifications to the zoning code that would automatically allow a lower classification, meaning a higher
use, to be administratively approved through the recommendation of such an ordinance to the City Council and by the Engineering Department’s discretion.
