MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: September 10, 2018 6:31 p.m. – 6:37 p.m.
ATTENDANCE: Commissioners: Brannen, Brittenum, Twitty, and Chairman Healey were present. City Attorney Bamburg was also present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Healey declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Brannen moved, seconded by Commissioner Brittenum to approve the regularly scheduled meeting minutes of May 16, 2018. MOTION CARRIED.
VARIANCE(S): Front yard setback variance at 808 Quince Hill Road
Chairman Healey opened the public hearing at approximately 6:33 p.m.
Mr. Michael D. Dietz of Doug Wilkinson Realty stated that he is representing the owners/sellers of the property located at 808 Quince Hill Road. He explained that he had a contract
to close and upon receiving a new survey, he learned that when the house was built in 1967, it was constructed approximately 3’ over the front building setback line. He stated that
the majority of homes in the area have a 40’ setback and homes in Jacksonville have a 35’ and 25’ front setbacks. He stated that a variance is required in order to close and get title
work on the property.
City Attorney Bamburg reiterated that in order for the mortgage company and title company to clear everything out in the manner that they have to, in order to process both the loan and
the closing on the property, we have to have a variance of record granted by the Board of Adjustment. He stated that a 3’ variance for a 40’ setback is unusual for Jacksonville, adding
that the current setbacks are 35’ or 25’. He explained that it was confirmed that the property was platted with a 40’ setback.
Mr. Dietz related that the mortgage company did not want to issue a “clear to close” or title insurance without a variance. He noted that the lots on this street are larger than the
normal sized lot, pointing out that the lots are 100’ wide by 200’ deep.
Commissioner Brannen moved, seconded by Twitty to approve the variance request for a front yard setback at 808 Quince Hill Road. MOTION CARRIED.
Chairman Healey closed the public hearing at approximately 6:37 p.m.
ADJOURNMENT:
Without objection, Chairman Healey adjourned the meeting at approximately 6:37 p.m. MOTION CARRIED.
