MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: June 12, 2017 6:31 p.m. – 6:46 p.m.
ATTENDANCE: Commissioners: Scholl, Healey, Brittenum and
Chairman White were present. City Attorney Bamburg
and City Engineer Whisker were also present.

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman White declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Healey moved, seconded by Commissioner Scholl to approve the
regularly scheduled meeting minutes of April 10, 2017. MOTION CARRIED.
VARIANCE(S): a. Front Yard Setback Variance 908 Grazing Lane
Chairman White opened the public hearing at approximately 6:30 p.m.
Petitioner representative Mr. Edward Avant explained that the request is
to obtain permission to keep a portable carport that was installed in front
of Ms. Louise Hubbard’s home at 908 Grazing Lane. He related that the
purpose of the carport is to keep Ms. Hubbard out of the weather, adding
that they were unaware of the requirement for a variance prior to the carport
being installed.
Discussion ensued and it was clarified that the structure is 20’ in length
so the variance request would require a 20 variance since the home is
constructed at the 35’ building code setback.
With no one else from the audience presenting to speak, Chairman White
closed the public hearing at approximately 6:36 p.m.
City Engineer Whisker stressed that the front build line is the most
zealously held building code that is not readily granted variances. He
explained that typically other options are worked out, noting that the
project was started without them knowing that it would require a building
permit. He added that the carport has not yet been staked down, saying
that it could be moved if needed. He then explained that the reason for
the portable carport was because a wheelchair ramp had been constructed
under the existing carport to the carport entry door. He went on to say
that since his tenure and to his knowledge he is unaware of any variance
that has been granted for front yard portable carports. He added that there
have been several request over the years.
Commissioner Healey questioned if there are other available options, given
that Ms. Hubbard’s handicapped hinders her ability to move faster out of
the weather to access the ramp into her house. He stated that he cannot
discern any other option.
City Engineer Whisker stated that the other option would be to reconfigure
the ramp under the existing carport so that the smaller size compact car
that Ms. Hubbard drives would fit under the existing carport.

Mr. Avant pointed out that if the ramp was reconfigured to go across the
back of the carport then the ramp would be too steep for Ms. Hubbard to
maneuver.
City Engineer Whisker offered that it could be made into an “S” curve with
a landing at the rear of the carport.
Mr. Avant expressed doubt if it would fit without going onto the neighbor’s
property.
City Engineer Whisker stated that the other option would be to lengthen
the roof to the side to continue the carport out toward the neighbor. He
then added that the room available would only be about 8’, saying that he
is unsure of the side yard setbacks.
Commissioner Healey moved, seconded by Commissioner Scholl to deny the
request regarding a front yard setback variance at 908 Grazing Lane. MOTION
CARRIED.
Chairman White questioned if there could be a temporary acceptance.
City Attorney Bamburg stated that because of the motion to deny, nothing
else would be applicable.
b. Maximum Square Footage Variance 1000 Madden Road
Mr. Sam Bostic, Jr. stated that they are proposing to construct a
carport/storage cover in the rear yard to store tractors and boats.
In response to a question from Chairman White, Mr. Bostic replied that the
property consists of 9 acres.
City Engineer Whisker related that 1000 Madden Road has two houses on the
property and the storage would be used to house the equipment they use to
maintain the acreage. He stated that the Code allows 650 square feet and
the request is for a storage unit of 1500 square feet. He explained that
even though the sides would not be closed in, it still requires a building
permit. He stated that the structure is not in a subdivision which typically
has smaller lots, so he does not foresee a problem. He reiterated that this
property consists of 9 acres.
In response to a question from Chairman White, Mr. Bostic stated that the
structure would be approximately 13’ in height.
Commissioner Healey moved, seconded by Commissioner Scholl to approve the
variance regarding maximum square footage for an accessory building. MOTION
CARRIED.

Without objection, Chairman White adjourned the meeting at approximately
