MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: June 13, 2016 6:30 p.m. – 6:37 p.m.
ATTENDANCE: Commissioners: Art Brannen, Virgil Healey, and Chairman Rick White were present. City Attorney Bamburg and City Engineer Whisker were also present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Rick White declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Brannen moved, seconded by Commissioner Healey to approve the regularly scheduled meeting minutes of April 11, 2016. MOTION CARRIED with Chairman White voting AYE.
VARIANCE(S): Sign Package Variance 1811 North First Street Hardees Restaurant
Chairman White opened the public hearing at approximately 6:31 p.m.
Mr. Joshua Wolfe stated that the request is for a second pylon sign on the rear Hwy. 67/167 side of Hardees Restaurant. He stated that the proposal is for the standard Hardees corporate
sign package. He stated that they are requesting that Hardees have the same advertising opportunities as other businesses in the area, to have two pylon signs one on North First Street
and one on Hwy. 67/167. He then related that one pylon is 45’ and the other is on Hwy. 67/167 is 60’ tall.
City Engineer Whisker stated that the request is for the total corporate package, saying that the request involves a variance for the height over 40’ and for the additional signs. He
related that a lot of the properties touch both North First Street and Hwy. 67/167. He then explained that this property backs up to another tract with an access easement to the Hardees
property.
He then answered Chairman White that this request is very similar to what is already going on along the Hwy. 67/167 side.
Mr. Wolfe pointed out that Taco Bell, Sonic, and Rally’s have pylon signs on both sides of their properties.
City Engineer Whisker then confirmed that the heights of those signs are comparable.
Chairman White closed the public hearing at approximately 6:36 p.m.
Commissioner Healey moved, seconded by Commissioner Brannen to approve the sign package for Hardees Restaurant at 1811 North First Street as requested. MOTION CARRIED with Chairman White
voting AYE.

Without objection, Chairman White adjourned the meeting at approximately 6:37 p.m. MOTION CARRIED.
