MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: February 08, 2016 6:30 p.m. – 6:35 p.m.
ATTENDANCE: Commissioners: Ronnie Higgins, Art Brannen, Virgil
Healey, and Chairman Rick White were present. City
Attorney Bamburg and City Engineer Whisker were also
present.

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Rick White declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Brannen moved, seconded by Commissioner Higgins to approve
the regularly scheduled meeting minutes of January 11, 2016. MOTION
CARRIED.
VARIANCE(S): Maximum square footage variance at 4322 Amy Lane
Chairman White opened the public hearing at approximately 6:31 p.m.
Petitioner Richard Carney informed the Board that he built his house in
1999. He stated that his daughter has epilepsy and has seizures once or
twice a year; however, she cannot drive so instead of her renting her own
place and trying to find a ride, he decided to build a small 510 square
foot house for her in his backyard. He continued saying it is a very modern
house with the same siding and same architectural shingles of his home.
He explained that his daughter is now married and pregnant; explaining that
the 510 square feet is not big enough her family. He further explained
that he is proposing to add an additional 14 X 20 room addition. He stated
that contractors Tracy and Andy Smith built the original house and they
would build the addition. He continued saying that the house will then
be 790 square feet, but will only take up 80% of the backyard.
Mr. Carney then offered the Board photographs of the small house.
In response to a question from Chairman White, the room addition would be
connected to the back and side of the tiny house.
Mr. Carney stated that he purchased the house in 1999 for $118,000, and
it appraised ten years later for $165,000, adding that after the small house
was built it then appraised for $225,000, therefore the property value has
increased.
City Engineer Whisker stated that Mr. Carney’s property is R-1 single
family, adding that as long as a single family lives there then there isn’t
a problem. He related that this is something new that has been going on
for the last five to ten years where parents sell their home and the children
either add on to their house or build a smaller home on the property to
help take care of them, adding that all of the utilities for the house are
still attached on one meter, therefore there is one bill so that helps to
enforce the one-family unit rule, making it more difficult for the property
to become rental. He continued that the small house was constructed to
the rear of the back yard and the addition will be “L” shaped back toward
the primary residence so that it would not go any further toward the rear
property line.

City Engineer Whisker then answered Chairman White, that there is no issue
regarding easements, explaining that the only variance is the maximum 650
square footage for an accessory building.
Commissioner Brannen moved, seconded by Commissioner Higgins to approve
the variance at 4322 Amy Lane as requested. MOTION CARRIED.
ADJOURNMENT:
Without objection, Chairman White adjourned the meeting at approximately
6:35 p.m. MOTION CARRIED.
