MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: October 13, 2014 6:30 p.m. – 6:43 p.m.
ATTENDANCE: Commissioners: Vergil Healey, Art Brannen, Rick White, Alderman Howard and Chairman Moore were present. City Attorney Bamburg and City Engineer Whisker were present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Moore declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Alderman Howard moved, seconded by Commissioner White to approve the regularly scheduled meeting minutes of August 11, 2014. MOTION CARRIED.
VARIANCE(S): a. Fence Variance 405 South James Street
Chairman Moore opened the public hearing at approximately 6:31 p.m.
No one was present to represent the Fence Variance request at 405 South James Street.
Chairman Moore closed the public hearing at approximately 6:31 p.m.
b. Building line setback variance 1500 Angie Court
Chairman Moore opened the public hearing at approximately 6:31 p.m.
Representative for petitioner Martin Carodine, Wanda Spivey with Century 21 stated that the owner is selling the house located at 1500 Angie Court. Ms. Spivey informed the Board that
according to a recent survey, the front porch to the home is slightly over the buildline. She then noted that the home was built approximately 30 years ago. She then clarified with
Chairman Moore that only the corners of the front porch are over the buildline.
City Engineer Jay Whisker concurred that the home was built approximately 30 years ago. He calculated that the petitioner would need a 4’ variance to bring the front porch into compliance.
Chairman Moore closed the public hearing at approximately 6:32 p.m.
Alderman Howard moved, seconded by Commissioner White to approve a 4’ front yard buildline variance at 1500 Angie Court as requested. MOTION CARRIED.
Discussion ensued regarding the absence of a representative for the item of business addressing a fence variance at 405 South James Street. City Engineer Whisker stated that the petitioner
was aware of the meeting date and time, adding that he also called shortly before the meeting but the call went to voice mail.
City Engineer Whisker then informed the Board that the new owner would need to apply for a sign permit, explaining that he changed the face of the existing signage.

Commissioner White noted that the item of business will most likely come back before the Board, requesting additional information.
City Engineer Whisker stated that the variance would be to place barbed wire on the chain link fencing. He explained that the fencing ordinance is very specific regarding the application
of barbed wire to fencing. The fencing ordinance allows for barbed wire in agriculture zones and manufacturing of M-1 and M-2 zones. He pointed out that most manufacturing plants have
a 6’ raised barb wire fence. He explained that other zoning classifications would need a variance from the Board of Adjustments to allow barbed wire fencing. He related that it is
incumbent upon the petitioner to provide good reasoning for the use of barbed wire and it would have to be placed 6’ or higher. He related that a storage unit business would have security
issues and barbed wire at the top of the fence would address access concerns. He added that this would not be an uncommon practice for storage unit businesses.
In response to a comment from Alderman Howard, City Engineer Whisker recalled that the Board had previously approved barbed wire fencing in a residential zone along West Main Street.
Chairman Moore noted there is some barbed wire fencing located on Oak Street adjacent to residential property. He stated the storage unit business is zoned commercial. He suggested
the current fencing ordinance may need to be revisited to expand allowable uses.
In response to a question from Chairman Moore, City Engineer Whisker answered that the front fence area is the only area being proposed regarding the variance.
Chairman Moore suggested City Engineer Whisker coordinate with Metroplan regarding training for the Board of Adjustment.
Discussion ensued and City Engineer Whisker agreed to arrange training for both Planning Commission and Board of Adjustment.
Chairman Moore issued concerns regarding the limited information available to determine the specifics of the variance request at 1500 Angie Court.
He requested that more complete information be provided to the Board prior to the meeting date.
City Engineer Whisker related that he would provide a form for each petitioner regarding meeting times and dates as well as any pertinent information as necessary.
Commissioner White concurred that there are times when there is not enough information made available for them to discern the specifics prior to the meeting.
It was the conclusion of the Board to extend the public hearing regarding the fence variance at 405 South James Street to the next regularly scheduled Board of Adjustment meeting.
