APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting of April 14, 2014 1-3 3. VARIANCE REQUEST(S): Rear Yard Setback Variance 913 Timberwolf Trail Petitioner: Sheila Lewis 4-6 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 12, 2014 6:30 p.m. – 6:39 p.m. ATTENDANCE: Commissioners: Vergil Healey, Art Brannen, Rick White, and Chairman Moore were present. City Attorney Bamburg and City Engineer Whisker were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Moore declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner White moved, seconded by Commissioner Brannen to approve the regularly scheduled meeting minutes of April 14, 2014. MOTION CARRIED. VARIANCE(S): Rear yard setback variance at 913 Timberwolf Trail Chairman Moore opened the public hearing at approximately 6:31 p.m. Petitioner Sheila Lewis explained that she would like to construct a sunroom on the rear side of her home at 913 Timberwolf Trail. She stated that she would like to enclose the area that is currently an open porch with a roof. She then explained that she has a wasp problem in the back yard, noting that the wasp have ruined the electrical wiring in the ceiling fan. She then answered that the enclosed area would cover the existing concrete slab. City Engineer Whisker explained that the property narrows as it goes toward the rear property line with an inverted point, noting that the rear of the house is already into part of the 25’ rear yard setback. He stated that if the Board approves the variance it would need to included any area of the house that is already into the setback. Chairman Moore noted that the patio concrete area is approximately 270 square feet according to the County’s website. City Engineer Whisker clarified that the request is to extend the roof and enclose the area that has concrete across the back of the home. It was clarified that she has a rear porch but wants to enclose the patio area. He then confirmed that the proposed construction would be approximately 17’ from the closest part of the rear property line including the roof line. He then answered that the fencing in not exactly right because currently the house measures 25’ off from the fence line. Ms. Lewis then answered Chariman Moore, that the extended area on the rear of the home is her master bedroom. City Engineer Whisker answered Chairman Moore that the retaining wall measures almost 25’ from the fence line. He then explained that the way the privacy fence was installed, she has some of her neighbor’s property and her neighbor has some of her property. City Attorney Bamburg clarified that the variance would only be concerned with the true property line and not the fence line. City Engineer Whisker reiterated that if the variance is considered from the property line the new construction would be 17’ from the closest part of her true property line. MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 12, 2014 6:30 p.m. – 6:39 p.m. Chairman Moore closed the public hearing at approximately 6:39 p.m. Commissioner White moved, seconded by Commissioner Healey to approve the setback variance as requested for 913 Timberwolf Trail. MOTION CARRIED. ADJOURNMENT: Without objection, Chairman Moore adjourned the meeting at approximately 6:39 p.m. MOTION CARRIED.
