MINUTES: BOARD OF ADJUSTMENT SPECIAL MEETING
DATE AND TIME: March 31, 2014 6:30 p.m. – 6:35 p.m.
ATTENDANCE: Commissioners: Alderman Howard, Vergil Healey,
Art Brannen and Chairman Moore were present.
City Attorney Bamburg and City Engineer Whisker
were present.

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Moore declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
VARIANCE(S): a. Setback Variance at 2217 Memorial Drive
Chairman Moore opened the public hearing at approximately 6:31 p.m.
Representative Rhonda Williams related that in selling the house, a survey
revealed that the house was built over the setback. She stated the need
for a variance for the sale of the property.
Commissioner Brannen clarified that the need for the variance was because
of a part of the home built between the carport and patio measuring 14.6
X 20 feet.
City Engineer Whisker stated that the house was originally constructed in
1972 and another building permit was taken out in 1974. He explained that
the carport and extension was constructed with one of those building
permits. He explained that house was constructed on the north half of lots
1 & 2. He stated that the north half was separated for the construction
of this house and then another house was built on the south half of those
lots. He explained that this is why there is a 35’ setback on the north
building line, which would have been the front building line but became
the side building line when they faced the house toward Memorial Drive.
He added that he could not speak to what the thought process was back in
1974.
He then answered Chairman Moore that the carport is part of the setback
variance since it has a roof.
City Engineer Whisker noted that the part of the carport and porch extend
into the 25’ setback for the front of the house. He stated that either
way it would require a variance, noting that the conditions have existed
for almost 40 years.
Chairman Moore closed the public hearing at approximately 6:34 p.m.
Alderman Howard moved, seconded by Commissioner Healey to approve the
setback variance as requested for 2217 Memorial Drive. MOTION CARRIED.
b. Setback Variance 3301 North Ridge Drive
Petitioner was not present to represent the item of business.
Alderman Howard moved, seconded by Commissioner Healey to table the item
of business until the next regularly scheduled Board of Adjustment meeting

of April 14, 2014. MOTION CARRIED.

ADJOURNMENT:
Without objection, Chairman Moore adjourned the meeting at approximately
6:35 p.m. MOTION CARRIED.
