Sign Variance Marshall Road Baptist Church 821 Marshall Road Petitioner: Toby Talley Senior Pastor 5-10 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 10, 2014 6:30 p.m. – 6:41 p.m. ATTENDANCE: Commissioners: Alderman Howard, Rick White, Vergil Healey and Chairman Moore were present. City Attorney Bamburg and City Engineer Whisker were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Moore declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Howard moved, seconded by Commissioner White to approve the minutes of the regularly scheduled Board of Adjustment meeting of February 18, 2014 as presented. MOTION CARRIED. VARIANCE(S): DEVIATION IN AGENDA: b. Sign Variance at 821 Marshall Road for Marshall Road Baptist Church Chairman Moore opened the public hearing at approximately 6:30 p.m. Pastor Toby Talley referenced the supplied material depicting the LED signage that they are requesting. He noted that the traffic count in front of the Church is approximately 13 thousand daily. He stated that the LED sign is slightly larger than code allows so that is why they are requesting a variance. He then answered that the existing signage would be removed and the new sign would be placed closer to the flagpole. He noted that the new signage is approximately 15’ tall and the old sign is 9.5’. City Engineer Whisker stated that Churches are allowed to have a 16 square foot sign and this would be slightly under 90 square feet total. He stated that as LED signs have become more popular each one has been brought before the Board for various reasons. He stated that this one is for a size variance. He related that the sign will be over 8’ tall into the air so that they can put it on the property line as required by Ordinance. He stated that the signage would be comparable to the LED sign at the First Baptist Church on North First Street even though that sign is lower to the ground and longer in length. Discussion ensued regarding the hold time and the brightness factor. Director of Administration Jim Durham stated that as with larger cities as more signs come in the City may develop an ordinance to address hold times. Chairman Moore closed the public hearing at approximately 6:36 p.m. Alderman Howard moved, seconded by Commissioner White to approve the sign variance as requested for 821 Marshall Road. MOTION CARRIED. RESUME AGENDA: a. Signs Variance 500 Madden Road for First Impressions Chairman Moore opened the public hearing at approximately 6:37 p.m. BOARD OF ADJUSTMENT REGULAR MEETING March 10, 2014 Mr. Jim Durham related that the building was built in 1999, explaining that it had six bays and his wife’s store took up three bays. He stated that this issue was brought to his attention by City Engineer Whisker. He related that his wife now has a number of businesses operating under one permit. He explained that she is advertising the various specialties using the six bays. He stated that the only alternative to advertising on the building was to install an electronic sign, adding that he feels the present signage looks more professional. He stated that as she began to move into the other spaces and adding signage it became noncompliant. He stated that he wanted to make thing right. City Engineer Whisker stated that the building could accommodate six businesses so there is a sign space for six businesses but each business is only allowed two signs. He explained that one is allowed on the building and one sign on the street; unless you have a street corner then you are allowed one for each side of the street. He noted that there is some signage on the side, which is fine. He clarified that the variance is for the number of signs. He stated that the easiest way to handle this would be to accept the signage as a sign package. Commissioner White pointed out that it is similar to a store like Kroger that has one sign to identify the business but also has signage to advertise their specialties. City Engineer Whisker stated that the difference is that businesses like Kroger, Wal-Mart, and McDonalds were approved as corporate sign packages. He stated that all sign packages are moved through the Board of Adjustment. Commissioner White moved, seconded by Commissioner Healey to approve the sign variance as requested for 500 Madden Road. MOTION CARRIED. Chairman Moore closed the public hearing at approximately 6:41 p.m. Alderman Howard moved, seconded by Commissioner Brannen to approve the LED signage as requested for 209 South Redmond Road. MOTION CARRIED. ADJOURNMENT: Without objection, Chairman Moore adjourned the meeting at approximately 6:41 p.m. MOTION CARRIED.
