MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: August 11, 2014 6:30 p.m. – 6:46 p.m.
ATTENDANCE: Commissioners: Vergil Healey, Rick White,
Alderman Howard and Chairman Moore were present.
City Attorney Bamburg and City Engineer Whisker
were present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Moore declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner White moved, seconded by Alderman Howard to approve the regularly scheduled meeting minutes of May 12, 2014. MOTION CARRIED.
VARIANCE(S): a. Sign Package Variance at 717 North J.P. Wright Loop Road
Chairman Moore opened the public hearing at approximately 6:32 p.m.
Lauren Fowler related that she is a State Farm agent in Jacksonville, explaining that she and her husband are building a State Farm agency at 717 J.P. Wright Loop Road. She continued
saying that they are proposing to build a sign that would require a 10’ offset from the road, adding that her property starts 27.5’ from the roadway. She stated that she did not believe
that it would block the view for traffic.
City Engineer Whisker stated that the sign ordinance requires that the sign has to be less than 3’ or higher than 8’ so that traffic has a site distance that can be seen. He referred
to the location, noting that the driveway is actually 27.5’ in length, which is over a car length. He stated that cars need to be able to pull up without signage blocking their view.
He went on to say that in this particular instance, the right-of-way is lengthy so it would not be a problem. He noted that the ordinance directs that the sign has to be 10’ off the
property line, explaining that the request is to have the sign at the property line instead because of the distance that she is already back from the roadway. He then answered that
if the sign were 10’ off the property line then it would be 37.5’ from the roadway.
In response to a question from Chairman Moore, Ms. Fowler explained that the sign will match the exterior of the building. She then added that she has not yet determined if the sign
would be lighted in some way. She related that the sign would have two brick columns, explaining that she is working with the builder to decide if it will have a stucco background
with a lighted State Farm logo. She added that she is unsure of the exact dimensions at this point.
Chairman Moore noted that the size cannot exceed the 16 square feet limitations according to the ordinance.
Ms. Fowler stated that she would follow the size requirements of the ordinance.
City Engineer Whisker noted that the property is zoned C-3, which allows for up to a 200 square foot sign.

Chairman Moore then noted that the request includes an entrance and exit signage. He added that when he visited the site, he only noticed one driveway into the property.
She stated that it would only be on directional sign for marking the driveway.
Chairman Moore closed the public hearing at approximately 6:38 p.m.
Commissioner Healy moved, seconded by Commissioner White to approve the sign variance at 717 North J.P. Wright Loop Road as requested. MOTION CARRIED.
b. Accessory building variance at Ray Motors, Inc. at 7209 John Harden
Chairman Moore opened the public hearing at approximately 6:40 p.m.
Mr. Gerald Ray stated that they are requesting permission to construct a 60’ X 90’ accessory building to be located at the rear of Ray Motors on John Harden Drive.
City Engineer Whisker stated that the allowable maximum square footage for an accessory building is 650 square feet. He stated that typically it has been allow for commercial properties,
as a manner of being business friendly, without any objections from neighboring businesses. He then answered that the ordinance requires that the building be 10’ from the property
line.
In response to a question from Commissioner Healy, City Engineer Whisker explained that there would be a smaller drive leading to the south end of the property for access.
Chairman Moore closed the public hearing at approximately 6:42 p.m.
Alderman Howard moved, seconded by Commissioner White to approve the variance request for a 60’ X 90’ accessory building at 7209 John Harden as requested. MOTION CARRIED.
c. Accessory building variance at 1602 Hunters Chase
Chairman Moore opened the public hearing at approximately 6:42 p.m.
Scotty Parker of S&H Parker Construction represented the item of request. He stated that his Company has been hired to construct a detached garage/shop next to the residence. He stated
that the dimension would be approximately 816 square feet, which exceeds the limit of 650 square feet.
He noted that all other guidelines have been met regarding setbacks.
City Engineer Whisker stated that the property is a larger residential lot, noting that the lots in Foxwood Estates range from 3.5 to 5 acre lots.
Mr. Phillip Carlisle noted that there are two accessory building, pointing out that one is 27’ X 60’ and then another one that is 25’ X 38’.

Chairman Moore closed the public hearing at approximately 6:45 p.m.
Commissioner White moved, seconded by Commissioner Healy to approve the
variance request regarding a 34’ X 24’ accessory building at 1602 Hunters Chase as requested. MOTION CARRIED.
ADJOURNMENT:
Without objection, Chairman Moore adjourned the meeting at approximately 6:46 p.m. MOTION CARRIED.
