MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: September 9, 2013 6:30 p.m. – 6:36 p.m.
ATTENDANCE: Commissioners: Alderman Howard, Rick White
and Chairman Ott were present.
City Attorney Bamburg was present.

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Ott declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Alderman Howard moved, seconded by Commissioner White to approve the
minutes of the regularly scheduled Board of Adjustment meeting of August
12, 2013 as presented. MOTION CARRIED.
VARIANCE(S): Rear Yard Setback Variance at 401 East Martin Street
Chairman Ott opened the public hearing at approximately 6:30 p.m.
Mr. Barry Cruz explained that he is proposing to extend the existing roof
line of his residence to cover a 14’ X 25’ patio. He related that there
is an existing patio that he plans to enlarge the concrete pad area to the
same dimensions.
City Attorney Bamburg stated that he would represent the item of business
on behalf of the City. He related that City Engineer Whisker did not have
any issues or concerns with the proposed variance, noting that there were
no calls from any of Mr. Cruz’s neighbors.
Chairman Ott closed the public hearing at approximately 6:35 p.m.
Commissioner Moore explained that as president of the Stonewall Property
Owners Association, he visited with Mr. Cruz regarding his proposed plans.
He then noted the Association met and reviewed those plans, voting to
recommend approval to the City of Jacksonville Board of Adjustment. He
stated that the Association Board ruled that the patio extension with roof
line has to remain an open porch type structure and cannot be modified at
anytime during construction or in perpetuity to become a closed section
addition to the house according to the Stonewall Property Owners
Association Bill of Assurance.
Commissioner White moved, seconded by Alderman Howard to approve a variance
of 14’ from the rear of the extension to the rear property line regarding
an open covered patio as requested. MOTION CARRIED.
ADJOURNMENT:
Without objection, Chairman Ott adjourned the meeting at approximately 6:36
p.m. MOTION CARRIED.
