MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: June 11, 2012 6:30 p.m. – 6:37 p.m.
ATTENDANCE: Commissioners: Joe Ott, Alderman Howard,
and Jim Peacock, Jr. were present.
Chairman Glen Keaton also answered roll call.
City Engineer Whisker and City Attorney Bamburg
were present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Keaton declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Ott moved, seconded by Alderman Howard to approve the minutes of the rescheduled Board of Adjustment meeting of May 17, 2012. MOTION CARRIED.
VARIANCE(S): a. Accessory building maximum square footage variance

Chairman Keaton opened the public hearing at approximately 6:30 p.m.
Mr. John Moore related that he is proposing to construct a wood working shop of 864 square feet, adding that he would also use the building to store his golf cart and lawn mowers. He
explained that the building would have a brick façade, measuring 24’ X 36’. He added that the building will not have plumbing or electric initially, but that he would add electric
at a later date. He stated that the building would have the same slope and architectural shingles as the residential roof and be located 8’ from the property line on the west side of
the property.
It was noted that there were no calls received from neighbors regarding the variance as requested.
In response to a question from Commissioner Ott, City Engineer Whisker answered that City Code requires that any accessory building be located no closer than 5’ from the property line.
He surmised that the bill of assurance for this Subdivision is probably 10% or 8’ maximum. He then answered that larger lots often request a larger than 650 square foot accessory building,
adding that it has not been an issue unless there is some complaint from a neighbor.
Mr. Moore related that there was some interest from his neighbors regarding the sign posting, but he explained to them that it was for an accessory building.
City Engineer Whisker confirmed with Mr. Moore that his intention is to have the fence even with the accessory building so that there will be a door that leads into the shop from the
front yard as well as an access from the rear yard using rise-up doors.
Alderman Howard moved, seconded by Commissioner Peacock to approve the variance as requested. MOTION CARRIED.

b. Front yard setback variance at 604 Vine Street
Chairman Keaton opened the public hearing at approximately 6:35 p.m.
Mr. Robert Beard related that the homes on Vine Street have been there since the 50’s and they are proposing to update the look on the front of their house.
Mrs. Fran Beard then explained that they had provided photographs of the concept for the front of the house. She related that they want to cover the new concrete landing at the front
door.
Mr. Beard noted that the variance would be for 3’ into the front yard setback.
In response to a question from Alderman Howard, Mr. Beard replied that there are other houses in the area that extend out in the front setback.
City Engineer Whisker stated that request to construct a cover over the front door has been a simpler type of variance granted in the past. He added that 3’ is generally not considered
a major encroachment. He then noted that one house on Vine Street doubled the size with a second story, adding that he believes some of the houses have grandfathered extended carports.
Commissioner Ott moved, seconded by Commissioner Peacock to approve the front yard setback variance as requested. MOTION CARRIED.
Chairman Keaton closed the public hearing at approximately 6:35 p.m.

Without objection, Chairman Keaton adjourned the meeting at approximately 6:33 p.m. MOTION CARRIED.
