MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: April 16, 2012 5:30 p.m. – 5:37 p.m.
ATTENDANCE: Commissioners: Joe Ott, Leroy Akridge
Alderman Howard and Jon Johnson were present.
Chairman Glen Keaton also answered roll call.
City Engineer Whisker and City Attorney Bamburg
were present.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Keaton declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
VARIANCE(S): a. REAR YARD SETBACK VARIANCE 1812 North James Street
Chairman Keaton opened the public hearing at approximately 5:30 p.m.
Chairman Keaton recalled that the item was tabled from the regularly scheduled Board of Adjustment meeting of April 9, 2012, offering Mr. Childers an opportunity to revise his site plan
and reduce the encroachment into the 25’ setback.
Mr. Brian Childers explained that he reduced the length of the master bedroom by 4’ and 2’ from the bathroom and closet. He noted that this would reduce his request from 10’. He stated
that the 8’ in the breezeway needed to remain due to fire escape issues. He explained that there needs to be enough room to pass by the air conditioning units without having to climb
over.
City Engineer Whisker clarified that there is a window leading from a bedroom between the two A/C units, adding that if there were a fire in the house the escape should not be blocked
in any way. He stated that this is why the 8’ is necessary. He asked Mr. Childers if the new variance request is for 4’2”.
In response to a question from Chairman Keaton, City Engineer Whisker and City Clerk Davitt related that they had not received any calls from neighbors.
Alderman Howard stated that he did not feel the reduced amount is unreasonable.
Mr. Brian Childers answered Chairman Keaton that the original request was for a 10’ variance.
Commissioner Ott moved, seconded by Commissioner Akridge to approve the request for a variance of 4’2” at 1812 North James Street. MOTION CARRIED.
City Engineer Whisker noted that would leave 20’10” to the property line from the overhang.

Chairman Keaton closed the public hearing at approximately 5:37 p.m.

Without objection, Chairman Keaton adjourned the meeting at approximately 5:37 p.m. MOTION CARRIED.
