Joe Cummings, City Engineer Jay Whisker, and
Chairman Glen Keaton were present

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Keaton declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Ott moved, seconded by Commissioner Akridge to approve the
minutes of the regularly scheduled Board of Adjustment meeting of October
11, 2010 and special called meeting of February 22, 2011. MOTION CARRIED.
VARIANCE(S): a. 1508 Johnson Street Front Yard Setback Variance
Chairman Keaton opened the public hearing at approximately 6:30 p.m.
Mr. Robert Ballard requested to extend his roof to 10’ and Commissioner
Akridge clarified that the variance request is to extend the roof
additionally 6’3”. Mr. Ballard introduced his builder John Haggard to
entertain questions from the Board.
Mr. Haggard explained that currently the home has a shed style roof that
extends almost 4’ out, adding that the proposal is to further extend the
roof from the porch over the sidewalk.
In response to a question from Chairman Keaton, Mr. Ballard replied that
he is planning to have the entire roof re-shingled.
Commissioner Akridge noted that the roof on the house next door at 1510
Johnson also extends about the same distance from the street.
City Engineer Whisker stated that the street curve begins at Mr. Ballard’s
house. He then explained that Mr. Ballard had built a wheelchair ramp
underneath the carport, adding that the car when parked sticks out from
the carport 5 to 8 feet. He stated that Mr. Ballard has expressed that
he would like to be able to exit the vehicle without being in the weather.
He then noted that an addition of 4’ had been added to the front of the
house without a building permit.
Commissioner Akridge noted that such additions were built that way a long
time ago. He noted that several homes located behind the shopping center
were constructed in the same manner.
City Engineer Whisker cautioned that typically the front yard build line
is not something commonly granted a variance. He recalled a similar
instance when it was an issue of providing shelter from the weather. He
added that it is more common when it is not visually detectable.
Mr. Ballard offered that the street does curve in a rounded fashion in front
of his home.

Commissioner Akridge stated that he would not have a problem with granting
the variance. He related that he carefully viewed the property and the
plans regarding alignment to the other homes. He stated that he did not
feel the addition would look out of character for the neighborhood.
Commissioner Akridge moved, seconded by Commissioner Ott to grant a front
yard setback variance as requested to extend the roof line at 1508 Johnson
Street to accommodate wheelchair access regarding all weather conditions.
MOTION CARRIED.
Chairman Keaton closed the public hearing at approximately 6:36 p.m.
b. 2413 Estates Court Accessory Building Maximum Square Footage Variance
Chairman Keaton opened the public hearing at approximately 6:37 p.m.
Mr. Gary Sipes stated that it is his understanding that maximum square
footage allowable for unattached accessory buildings is 600 square feet
unless it is attached to the primary residence. He related that the proposed
building would be approximately 1500 square feet. He stated that he is
requesting a variance from the maximum allowable square footage without
having to attach the structure. He then related that his bill of assurance
only stipulates that the construction match the primary structure. He
stated that the use of the building would be living quarters for his parents,
explaining that he has moved his parents from White Hall to Jacksonville
due to illness.
City Engineer Whisker related that this is not an unusual situation; the
frequency of request is increasing due to factors such as families needing
to take on the responsibility of caring for parents due to illness or
economic issues. He explained that the original plan incorporated a
breezeway to connect the two structures but later decided to separate the
building from the primary residence.
Commissioner Akridge commented that he felt it would be more aesthetic
without the breezeway.
In response to a question from Commissioner Akridge, Mr. Sipes explaining
that the building would have a two-car garage to the front side of the
building.
City Engineer Whisker noted that the lot is approximately 5.0 acres.
Commissioner Ott moved, seconded by Commissioner Akridge to grant an
accessory building maximum square footage variance as requested at 2413
Estates Court. MOTION CARRIED.
Chairman Keaton closed the public hearing at approximately 6:40 p.m.
