MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: May 10, 2010 6:30 p.m. – 6:40 p.m.

Leroy Akridge, Joe Cummings, City Engineer Jay Whisker, and Chairman Chad Young were present

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Young declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brannen moved, seconded by Commissioner Ott to approve the minutes of the regularly scheduled Board of Adjustment meeting of April
12, 2010. MOTION CARRIED.
VARIANCE(S): Accessory Building Variance at 715 Foxwood Drive
Chairman Young opened the public hearing at approximately 6:30 p.m.
Chairman Young clarified that the request is in regard to the location of the proposed accessory building to an existing accessory building also located on the property at 715 Foxwood
Drive.
City Engineer Jay Whisker read JMC § 18.04.090 “No building shall be closer to any accessory building by fifteen (15) feet to a principal building or to any other accessory building”,
adding that this provision was adopted by Ordinance 213 of 1969. He noted that Ordinance 213 was one of the first zoning ordinances adopted by the City of Jacksonville. He then explained
that he had spoken with the Fire Marshall, who did not have a problem with the location of the proposed building, saying that he did not see any fire issues.
Mr. Kenny Elliott explained that the new building would be a garage, adding that the proximity of the two buildings being closer than 15’ would be more aesthetic.
Commissioner Akridge agreed that it would look better.
Mr. Elliott then explained that the proposed building would line up with the existing concrete and the driveway, adding that the existing accessory building would be shifted over.
In response to a question from Chairman Young, Mr. Elliott stated that he is planning to brick the front of the proposed garage but has not decided if the entire building would be brick.
He went on to say that the architectural elements would match the house. He assured the Board that it would not be a modular structure.
Chairman Young asked City Attorney Bamburg to explain the intent behind the code requiring 15’ of separation between accessory buildings.
City Attorney Bamburg stated that he was not privy to the Code intent developed in 1969.
Discussion ensued as to fire codes being the only plausible intent of the Code.
Commissioner Brannen moved, seconded by Commissioner Ott to grant the MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING

Chairman Young closed the public hearing at approximately 6:40 p.m.
ADJOURNMENT:
Without objection, Chairman Young adjourned the meeting at approximately 6:40 p.m. MOTION CARRIED.
