MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: February 11, 2008 6:30 p.m. – 6:38 p.m.
ATTENDANCE: Commissioners: Bart Gray, Jr., Glen Keaton, Chairman
Chad Young, and Acting City Engineer Jay Whisker were
present

City Clerk Susan Davitt recorded those listed above in attendance and
Chairman Young declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Keaton moved, seconded
by Commissioner Gray to approve the minutes of the regularly scheduled Board
of Adjustment meeting of January 14, 2008 as presented. MOTION CARRIED.
VARIANCE(S): Side Yard Setback 501 Jessica Court
Chairman Young opened the public hearing at approximately 6:30 p.m.
Mrs. Tammy Jeffery of 501 Jessica Court stated that she and her husband
were not aware of the requirement to obtain a building permit for a Jacuzzi
house in the back yard. She stated that someone from the City left a message
on their door, which lead them to apply for a variance.
Discussion ensued and it was determined that the variance request would
be from a 5’setback to a 4’ setback.
Mrs. Jeffery then answered that the roofing and siding would be identical
to the primary residence.
Acting City Engineer Whisker noted that when the City discovered the project
it was already in the framing stage of construction. He stated that the
project is 80% completed and is approximately 4’ from the property line.
He then answered that the main concern would be a neighbor’s complaint that
the structure is too close to the property line. He added that there is
a wooden privacy fence between adjacent properties.
City Clerk Susan Davitt answered that there were no calls of objection
registered.
Commissioner Gray noted that no one had appeared to present in opposition.
He pointed out that the property had been clearly posted.
In response to a question posed by Commissioner Gray, Mrs. Jeffery stated
that her neighbors had visited and seen the placement of the structure with
no complaint.
Chairman Young closed the public hearing at approximately 6:38 p.m.
Commissioner Keaton moved, seconded by Commissioner Gray to grant a 1’ side
yard setback variance for property addressed as 501 Jessica Court. MOTION
CARRIED.

ADJOURNMENT:
Without objection, Chairman Young adjourned the meeting at approximately
6:38 p.m. MOTION CARRIED.
