APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting March 12, 2007 1 3. VARIANCE REQUEST(S): a. Front and Rear Yard Setback Variance 1004 Highland Drive Petitioner: Gary Fletcher and Michael Evans 2-3 b. Rear Yard Setback Variance 1702 Swift Drive Lot 1, Fishnet Subdivision Petitioner: Fishnet Missions 4-5 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: April 9, 2007 6:30 p.m. – 6:41 p.m. ATTENDANCE: Commissioners: Bart Gray Jr., Mark Perry, Glen Keaton, Chairman Brannen, and Representing Engineer Whisker were present _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brannen declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Keaton moved, seconded by Commissioner Perry to approve the minutes of the regularly scheduled Board of Adjustment meeting of March 12, 2007 as presented. MOTION CARRIED. VARIANCE(S): a. Front and Rear Yard Setback Variance 1004 Highland Drive Chairman Brannen opened the public hearing at approximately 6:32 p.m. Petitioner Gary Fletcher related the problem of the lot being irregularly shaped, pointing out that there is no way to construct a front porch or rear deck and stay within the setbacks. He stated that a porch on the front would be a good aesthetic for the front view of the house. He presented photographs showing how the house lines up in conjunction with the adjacent home. He stated that a front porch would not obstruct the view of the neighbors to the east, pointing out that there is no neighbor on the west side. He then related that the street has a curve, which visually breaks the conformity of the front yard setback appearance. He stated that every inch of available land within the setbacks has been used, adding that this is not a very big house. He related that the house has had to be squeezed in to the setbacks. He stated that they would like to go ahead and request a back porch as well. In response to a question posed by Commissioner Perry, Mr. Fletcher explained that the front porch would be open but would be covered. He went on to explain that because the front porch is an open structure it would obstruct any view from down the street. He then related that by appearance it would seem that the neighbor to the east has a front porch that goes beyond the front setback. In response to a question posed by Commissioner Perry, City Clerk Susan Davitt answered that there had not been any opposition calls as a result of the property posting. Commissioner Gray moved, seconded by Commissioner Keaton to approve the front and rear yard setback variance as requested. MOTION CARRIED. Chairman Brannen closed the public hearing at approximately 6:38 p.m. b. Rear yard setback variance 1702 Swift Drive, Lot 1, Fishnet Subdivision Chairman Brannen opened the public hearing at approximately 6:39 p.m. Mr. Dewey Sims related a recent move from a location on Marshall Road to Swift Drive and the request to expand the operation of Fishnet Missions. He stated that he has visited with the area business owners who were not in opposition to his request. He related that it is his understanding that BOARD OF ADJUSTMENT REGULAR MEETING April 9, 2007 the property would be changed to C-2 eventually. Chairman Brannen closed the public hearing at approximately 6:40 p.m. In response to a question posed by Chairman Brannen, City Clerk Susan Davitt answered that there had not been any opposition calls as a result of the property posting. Representing Engineer Whisker clarified that there are some zoning and land use changes scheduled for property in the area, but none that he is aware of for that specific area. Commissioner Gray moved, seconded by Commissioner Keaton to approve the front and rear yard setback variance as requested. MOTION CARRIED.
