APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting February 14, 2005 1-2 Special Scheduled Meeting February 28, 2005 3 3. VARIANCE REQUEST(S): a. Sign Package Variance Chili’s Restaurant 1800 West Main Street Petitioner: Cuerden Sign Company (sign package included in packet) 6 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 14, 2005 6:45 p.m. – 6:53 p.m. ATTENDANCE: Commissioners: Commissioners Martha Boyd and Mike Traylor, Bart Gray, Jr. Chairman Keaton, City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Keaton declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boyd moved, seconded by Commissioner Traylor to approve the minutes of the Regularly Scheduled Board of Adjustment meeting of February 14, 2005 and the Special called Board of Adjustment meeting of February 28, 2005. MOTION CARRIED. VARIANCE(S): a. Front Yard Setback Variance 1300 Yellow Stone Drive Chairman Keaton opened the public hearing at approximately 6:30 p.m. Mr. Todd Underwood related that he is requesting a front yard setback from the required 35’ to 25’ at Lot 1 Parkview Subdivision addressed as 1300 Yellow Stone Drive. He explained that the shape of the lot does not allow for use of the lot observing the 35’ setback and keep a comparable size house for the Subdivision. He pointed out that if the lot were not triangular shaped the 35’ setback would not be a problem. In response to a question from Commissioner Gray, Mr. Underwood demonstrated on the drawing the placement of the home in regard to the 25’ and 35’ setbacks. In response to a question from Chairman Keaton, City Engineer Whisker stated that there is no site distance obstruction concern. He noted that the stop sign to Yellow Stone Drive is facing Pinnacle Drive. He then answered that a setback variance would allow the builder to line up the front of the house with the house on lot 2. Commissioner Gray moved, seconded by Commissioner Boyd to approve a 25-foot front yard setback variance at 1300 Yellow Stone Drive. MOTION CARRIED. Chairman Keaton closed the public hearing at approximately 6:34 p.m. b. Sign Package Variance for Chili’s Restaurant at 1800 West Main Street Chairman Keaton opened the public hearing at approximately 6:35 p.m. Mr. Jasper Burton of Cuerden Sign Company stated that he is representing Chili’s Restaurant regarding their request for a sign variance package for the Restaurant. He stated that the variance is basically for a 14’7” X 20’10” pole sign that is proposed to be raised to 60’ instead of the 45’ Code requirement. He noted that it would be close to the same height as the adjacent “Waffle House” sign. He noted that the sign direction would be perpendicular to the freeway. City Engineer Whisker stated that the City has typically granted exceptions for businesses located on or near the freeway where the structure is BOARD OF ADJUSTMENT REGULAR MEETING March 14, 2005 elevated over the road, such as James Street and this area of Main Street. In response to a question posed by Commissioner Boyd, Mr. Burton answered that the proposed sign package is basically the same sign package used by most Chili’s Restaurants. He then noted that the sign package has been updated to included new LED type signs. Discussion ensued regarding the placement of the sign and the flag pole on Main and Marshall used by the City. City Engineer Whisker stated that he did not feel the proposed placement would interfere with the flags but wanted to caution Mr. Burton of that chance. Mr. Burton stated that sign placement could be more carefully studied and if there is a conflict the sign placement could be more to the north to avoid that situation. Discussion ensued regarding the number of allowable signs for the outside of the building and it was concluded that Chili’s Restaurant would have three building sides that would face street frontage. City Engineer Whisker then noted that three outside building signs would still be in conformance with the sign ordinance. The Commission reviewed placement of outside building signs proposed to face street fronts. Commissioner Traylor moved, seconded by Commissioner Gray to approve the sign package for Chili’s Restaurant and grant a height of 60’ and size waiver of 285 square feet for the pole sign, stipulating that the pole sign not conflict with the City flagpole. MOTION CARRIED. Chairman Keaton closed the public hearing at approximately 6:45 p.m. ADJOURNMENT: Commissioner Boyd moved, seconded by Commissioner Traylor to adjourn the meeting at approximately 6:47 p.m. MOTION CARRIED.
