Rear Yard Setback Variance 1809 Swift Drive Petitioner: Mr. Chuck Meador 5 (site plan included in packet) ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: February 14, 2005 6:45 p.m. – 6:53 p.m. ATTENDANCE: Commissioners: Commissioners Martha Boyd and Mike Traylor Chairman Keaton, City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Keaton declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boyd moved, seconded by Commissioner Traylor to approve the minutes of the Regularly Scheduled Board of Adjustment meeting of January 11, 2005. MOTION CARRIED with Chairman Keaton voting AYE. VARIANCE(S): a. Rear Yard Setback Variance 1809 Swift Drive Chairman Keaton opened the public hearing at approximately 6:45 p.m. Mr. Chuck Meador related that he is requesting a rear yard setback from the required 75’ to 25’. He explained that he is constructing a 70,000 square foot warehouse that would not have any openings to the rear of the building. He stated that the parking, entrance/exit and dock areas would be located on the front and sides of the warehouse. He stated that in case of future expansion, he would not want to waste the property to the rear. He then related that the front and side of the building is proposed to be constructed in a manner conducive to future expansion. The Commission reviewed the property plat and proposed construction plan, noting that any future expansion would occur to the west end of the property. In response to a question from Chairman Keaton, City Engineer Whisker related that the difference between an M-1 and M-2 zoning is that an M-1 has a 25’ rear yard setback and M-2 has a 75’ rear yard setback. He related that M-1 has parking in the front with the factory near the back, adding that M-2 is set up just the opposite where the building is the front and all the parking is in the back. He related that the petitioner is requesting more of an M-1 setting for his M-1 business in the industrial area. He added that setbacks were designed to protect the adjacent property owners to the front or rear, noting that the rear adjacent property is the Vertac property to the south, which is zoned industrial. He then answered that parking would be to the front instead of the rear. He noted that the plat would be presented to the Planning Commission and if approved the petitioner would still be required to adhere to the landscaping plan. He then answered that the City has no objections to the variance request. Commissioner Traylor moved, seconded by Commissioner Boyd to approve a 25-foot rear yard setback variance at 1809 Swift Drive. MOTION CARRIED. Chairman Keaton closed the public hearing at approximately 6:52 p.m. BOARD OF ADJUSTMENT REGULAR MEETING February 14, 2005 ADJOURNMENT: Commissioner Traylor moved, seconded by Commissioner Boyd to adjourn the meeting at approximately 6:53 p.m. MOTION CARRIED.
