Vehicle Storage Variance 1007 South Redmond Petitioner: Ricky Hall ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 10, 2003 6:22 p.m. – 6:50 p.m. ATTENDANCE: Commissioners: Martha Boyd, Kevin McCleary, Glen Keaton and Chairman Perry City Representative, City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Perry declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boyd moved, second by Commissioner Keaton to approve the minutes of the Regularly Scheduled Board of Adjustment meeting of February 10, 2003 and the Special Called Meeting of January 17, 2003. MOTION CARRIED. VARIANCE(S): a. Rear Yard Setback Variance/100 Veterans Circle Chairman Perry opened the public hearing at approximately 6:20 p.m. Mr. Ben Rice, representing the L.R.A.F.B. Historical Foundation stated that the Foundation is in the process of establishing a museum at 100 Veterans Circle. He related that Mr. Chad Young is the project architect. He explained that the Foundation would like to expand the current building by 9,100 square feet to the rear. He noted that the property is zoned C-2, pointing out that the setback requirement is 10-feet plus a 10-foot alley. He stated that the building would be 6-feet from the property line, making the variance request for 4-feet. He stated that there would not be any problem regarding obstruction of traffic view. In response to a question posed by Commissioner Keaton, Mr. Young related that the property line tapers away from the asphalted alley. City Engineer Whisker concurred that the proposed construction would not hinder traffic traveling in the alley. It was noted that the extension would be 75-feet from the south entrance on Main Street. Mr. Young noted that the design could not be elongated because of a back entrance regarding an upstairs tenant, adding that it also provided for a back entrance to the museum from the parking lot. In response to a question posed by Chairman Perry, Mr. Young related that currently renovations are underway, adding that new construction may begin in a few months. He then answered that the building would be setback 18-feet from the southern property line. He demonstrated the scale of the addition in regard to the existing building and stated that the exterior of the addition would be coordinated to match the existing building exterior. It was noted that landscaping would be addressed. Chairman Perry closed the public hearing at approximately 6:32 p.m. Commissioner Boyd moved, seconded by Commissioner Keaton to grant a 4-foot rear yard variance at 100 Veterans Circle. MOTION CARRIED. b. Rear Yard Setback Variance/101 Ricky Raccoon Chairman Perry opened the public hearing at approximately 6:33 p.m. Mr. Randal Snow of Ideal Sunrooms, Inc. stated that he is representing the homeowner, Mrs. Jackie Campbell. He related that Mrs. Campbell had just BOARD OF ADJUSTMENT REGULAR MEETING March 10, 2003 6:20 p.m. – 6:50 p.m. purchased the home and was under the impression at the time of purchase that she would be able to expand the existing home. He presented copies of the plot plan demonstrating an existing concrete slab, which is where the sunroom is proposed. He related that there is a vacant lot to the rear of the home followed by an apartment complex. He related that the room would be constructed mostly of glass, adding that it would make a nice addition to the home. City Engineer Whisker noted that a portion of the house already exceeds the 25-foot setback, adding that the sunroom would match the portion that exceeds setback. Chairman Perry closed the public hearing at approximately 6:36 p.m. Commissioner Keaton moved, seconded by Commissioner Boyd to approve a five (5) foot rear yard setback variance request for 101 Ricky Raccoon. MOTION CARRIED. c. Vehicle Storage Variance/1007 South Redmond Road Chairman Perry opened the public hearing at approximately 6:38 p.m. Petitioner Mr. Ricky Hall stated that he is currently constructing a privacy fence at 1007 South Redmond Road. He stated that he is partners with his brother at the shop located at the address. He related that the rear of the property would be fenced, adding that the entire premise would eventually be fenced. He stated that the shop is a hobby not a business. He stated that Mr. Eddie Gates rents one of the three stalls and has moved his vehicles to comply with regulations. He stated that the middle stall is rented by a go-cart business and would not have extra vehicles on the premises. He stated that he occupies the third stall. City Engineer Whisker related that several of the vehicles were tagged for being inoperable, offering the owner seven (7) days to apply for a variance. He stated that the owner is requesting to be able to fence the back area to store inoperable vehicles. He added that the Mr. Hall has requested that he be allowed to keep operable vehicles in front for resale or personal use. It was noted that the front of the building faces Redmond Road. Mr. Hall related that he would be repairing the vehicles as a personal hobby, stating that he would like to store the inoperable vehicles behind the privacy fence until he has time to work on them. Discussion ensued as to the allowable fencing material; Mr. Hall stated that he purchased 6-foot wood material for a privacy fence. In response to a question posed by Chairman Perry, Mr. Hall stated that he felt it would take approximately ninety (90) days to complete the fence construction. He noted progress made since the citation was issued. City Engineer Whisker stated that he felt the most important area to be completed first would be the Redmond/Highland side of the property, adding BOARD OF ADJUSTMENT REGULAR MEETING March 10, 2003 6:20 p.m. – 6:50 p.m. that he felt the construction could be completed for that portion in approximately thirty (30) days with the remainder accomplishable in a sixty to ninety-day time frame. Discussion ensued regarding the time frame and it was the consensus to offer the petitioner until the end of May to complete the fencing project, asking him to return before the Board for an additional extension if the project has not been completed in that time frame. Chairman Perry closed the public hearing at approximately 6:48 p.m. Commissioner Boyd moved, seconded by Commissioner McCleary to approve an extension till the end of May to provide time for the construction of a privacy fence to the rear of the property; and to return to the Board of Adjustment if construction is not completed.
