VARIANCE REQUEST(S): Rear Yard Setback Variance 3508 South Ridge Drive Petitioner: Jessie Jones ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: July 28, 2003 5:15 p.m. – 5:25 p.m. ATTENDANCE: Commissioners: Martha Boyd, Glen Keaton, Susan Dollar, and Chairman Perry City Representative, City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Perry declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: VARIANCE(S): Rear Yard Setback 3508 South Ridge Drive Lot 46 Western Hills Subdivision Chairman Perry opened the public hearing at approximately 5:15 p.m. Petitioner Jessie Jones stated that the proposed home is a pre-sold. He related because of the unusual configuration of the lot he had trouble setting the house to the lot. He added that his buyer has already sold her home and is living in an apartment. City Engineer Whisker related that lot 29 directly south of the proposed lot is exactly 25’ from the rear property line. He noted that the requested variance is a 6.5’ variance. He then noted that the house could be moved approximately 1.5’ closer to the front property line, making the requested variance need 5.0’ instead of the requested 6.5’. In response to a question posed by Commissioner Dollar regarding the rear adjacent lot #29, Mr. Jones stated that the lot has been sold and Mr. Panhorst is the builder. Mr. Jim Peacock noted that Mr. Panhorst was not opposed to the requested variance. City Engineer Whisker noted that the lot is unusually configured and the buyer is requesting a larger home. He added that he did not feel that a 5’ variance would be unreasonable. Commissioner Dollar stated that this would be the exact purpose of a variance, noting that the shape of the property mandates the variance. Mr. Jones stated that a 5’ variance would be suitable. City Engineer Whisker explained the need for utilities to be able to gain access to rear easements. Chairman Perry closed the public hearing at approximately 5:25 p.m. Commissioner Boyd moved, seconded by Commissioner Dollar to grant a 5’ rear yard variance at 3508 South Ridge Drive. MOTION CARRIED. BOARD OF ADJUSTMENT REGULAR MEETING continued: July 28, 2003 ADJOURNMENT: Chairman Perry adjourned the meeting at approximately 5:25 p.m. MOTION CARRIED.
