01 APR 23 MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: April 23, 2001/ 6:30 p.m. 6:40 p.m. ATTENDANCE: Chairman Mark Perry, Commissioners: John Hardwick, Bobby Lester, and Martha Boyd City Engineer Whisker PETITIONERS: Variance requested: ICM Improved Construction Methods Redmond Road, Jacksonville, AR 72076 Setback variance for M-1 setbacks (Chapter 18.68.050) _______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Perry declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Lester moved, seconded by Commissioner Hardwick to approve the minutes of the regular Board of Adjustment meeting of February 12 2001 as presented. MOTION CARRIED. Chairman Perry related that the item of business regarding a variance for M-1 zoned setbacks of 70-foot front yard and 24- foot rear setback. He stated that the property is zoned M-2, which requires a 25-foot front setback and a 70-foot rear setback. Mr. Tommy Bond stated that it was not realized that there was such a disparity in the rear yard and front yard setback, pointing out that light industry has a greater setback than a heavier degree. He then noted that the same nature of disparity exists for C-3 and C-4 zones. He related that a C-4 requires a 25-foot setback and C-3 a 50-foot setback. City Engineer Whisker stated that he had spoken with Richard Magee from Metroplan and it was explained that light industry is moved back for more space from the road and heavy industry is placed toward the road to achieve a buffer from residential or other zoned property that is located behind that heavy industry use. He then related that in this instance there is 700-feet from the industry located behind ICM. Mr. Bond agreed, saying the property is part of the old Regal Ware Plant. He then related that an incident when 13-acres on General Samuels/Redmond Road was proposed for rezoning to R-3 and the people that lived behind the property resisted the multi-family and wanted to keep it industrial. Commissioner Hardwick moved, seconded by Commissioner Lester to approve the setback variance as requested for ICM on Redmond Road. MOTION CARRIED.
