00 MAR 13MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: March 13, 2000/ 6:30 p.m. 7:03 p.m. ATTENDANCE: Chairman Bart Gray, Jr. Commissioners: John Hardwick, Ken Nabors, and Martha Boyd City Engineer Reel represented the City of Jacksonville PETITIONERS: Variance requested: Media Brokers, Inc 108 Bafanridge Street Hot Springs, AR 71901 Billboard Review (Chapter 18.76.030 (B)(1) Rebsamen Hospital 1400 Braden Street Jacksonville, AR 72076 Billboard Review (Chapter 18.76.030 (B)(1) __________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Gray declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Hardwick noted that during the meeting of December 13, 1999 regarding signage to be located at 2200 T.P. White Drive for Fairfax Supply Inc. that he had questioned Mr. Howard, regarding additional signage and Mr. Howard had assured the Board that he would not require additional signage on the property. City Clerk Davitt will review tapes of the previous meeting and record such in those minutes to be included with presentation of the present minutes of the next regularly scheduled meeting of the Board of Adjustment. BILLBOARD REVIEW REQUEST: Media Brokers, Inc., 2200 T.P. White Drive Chairman Gray opened the public hearing at approximately 6:34 p.m. Mr. William Benham of Media Brokers related the desire to construct a billboard at the location of Fairfax Supply, 2200 T.P. White Drive. He explained that the billboard will be a single steel pole to withstand 70 miles an hour wind and will adhere to all City of Jacksonville signage codes for billboards. He explained the billboard would feature local advertisers which will be rented. Discussion ensued and it was related that the proposed location area is zoned R-4. Mr. Benham stated that the signage would be 18’ by 55’ with a 45’ height from the top of the billboard. City Engineer Reel stated that because of the size of the signage he would request consideration for a setback of 50 feet. BOARD OF ADJUSTMENT March 13, 2000 Commissioner Hardwick questioned the sign still located at the north end of Fairfax Supply, Inc. and City Engineer Reel related that he did not have Mr. Howard remove the sign because it was his understanding that the sign could remain. Commissioner Hardwick stated that the Board had been very accommodating to the request of Mr. Howard who had been before the Board in December for a sign request variance and that he was not in favor of placing more signage on the property. City Engineer Reel stated that he felt billboards are better-located in rural areas and that this location does not lend itself to signage of this size. Commissioner Nabors related that he had been contacted by a neighboring business owner who voiced disapproval for the location as a billboard site. City Clerk Davitt concurred that Mr. Jim Durham had contacted her office to registered disapproval of the same. Commissioner Hardwick returned to the approval of a sign variance for Fairfax Supply, Inc. and pointed out that approval of that sign package offered the owner many benefits, adding that part of that consideration was that there would be no additional signs for that location. Discussion ensued regarding complaints of the original signage placed at Fairfax Supply, Inc. It was noted that Mr. Howard had installed signage at some expense without consideration of City signage codes. Commissioner Hardwick stated that he was not in favor of additional signage in the same location. Commissioner Hardwick moved, seconded by Commissioner Nabors to deny the request. MOTION CARRIED. BILLBOARD REVIEW REQUEST: Rebsamen Hospital 129 John Harden Drive Ms. Margaret Corbett of Rebsamen Hospital related that the hospital would like to construct a billboard on property owned by the hospital and located along John Harden Drive across from the Main Street exit of Hwy 67/167 going south. She related that the property is zoned C-3. She then stated that Donrey Outdoor will construct the billboard that will be a 40-foot single pole, steel framed, two sided, v-backed billboard. She said that the printed surface would be 14’ by 48’ and will be more than 1400 feet from the nearest billboard located behind the Jacksonville Medical Clinic. She related that Rebsamen Hospital wants to advertise in order to be more competitive in the medical field. Discussion ensued and it was related that Rebsamen would hire Donrey Outdoor to construct the billboard. She added that the billboard would be owned by Rebsamen Hospital and will not be rented for advertisement but solely used by the Hospital and/or its clinics in Jacksonville and Cabot. BOARD OF ADJUSTMENT continued: March 13,2000 Discussion ensued as to the proposed location of the cell tower to be located in the general area. City Engineer Reel related that the proposed location is 125 feet from the proposed location of the Rebsamen billboard, adding that approval was more than a year ago and the company has not contacted the City regarding further plans to build. He stated that the company had an option for lease regarding the property. It was the general consensus of the Board that a possible 120-day length of time limit be placed on approval for cell tower construction. City Engineer Reel related that 100 feet is the maximum allowable height as determined in the Telecommunications Ordinance. Discussion ensued regarding application to the Highway Department for billboards located along interstates. City Engineer Reel related that the City’s regulations are more stringent than those of the Highway Department. Chairman Gray suggested that cell towers could be located on top of billboards. City Engineer Reel requested that if granted the billboard be constructed with a 50’ setback because of the size of the signage. The Donrey Outdoor representative stated that he did not believe the Highway Department regulated “on-premise” commercial signage explaining that Rebsamen owns the land and it will be used for their own advertisement. Commissioner Hardwick moved, seconded by Commissioner Boyd to approve the request from Rebsamen Medical Center regarding the construction of a billboard at 129 John Harden Drive. MOTION CARRIED.
