99 FEB 08MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: February 8, 1999 / 6:35 p.m. 6:50 p.m. ATTENDANCE: Chairman Mark Perry Commissioners: John Hardwick, and Art Brannen City Engineer Reel represented the City of Jacksonville PETITIONERS: Variance requested: Mark Goins and Kaye Briscoe 1715 T.P. White Drive Side Yard Setback (Chapter 18.68.050 Jax. Mun. Code) __________________________________________________________________ City Clerk Susan L. Davitt recorded those listed above in attendance and Chairman Perry declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Hardwick moved, seconded by Commissioner Brannen that the minutes of the Board of Adjustment Meeting of October 12, 1998 be APPROVED. MOTION CARRIED. VARIANCE REQUEST: Architect, Mr. John Ayres related that lot size, landscaping and future expansion considerations dictated the building location which negates a variance from the Jacksonville Municipal Code regarding a side yard setback. He related the request is for a variance from fifteen (15) feet to five (5) feet. He related approval from Captain Charles Pope with consideration for a one-hour fire wall. Discussion ensued as the positioning of the building and parking. It was related that the common drive leading through to North First Street would not be developed regarding consideration for curb cuts. Commissioner Hardwick questioned if setback approval should be contingent upon replat approval immediately following in the Planning Commission meeting. It was noted that until the replat is accepted by the Planning Commission the setbacks as presented do not technically exist. City Engineer Reel related that the property is zoned C-2, adding that if the Planning Commission were to deny the replat it would void prior setback approval made by the Board of Adjustment. Commissioner Hardwick speculated that the Planning Commission may find it hard to approve the replat without variance approval by the Board of Adjustment because of the lot size and development MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: February 8, 1998 / 6:35 p.m. 6:50 p.m. limitations. City Engineer Reel questioned expansion plans and noted that in review of the plat it showed access from T.P. White to North First. He related that a street could be built over an easement. Commissioner Brannen moved, seconded by Chairman Perry that the request be approved with the stipulation that the Planning Commission approve the replat as presented. Chairman Perry requested that the City Engineer approve development of access onto North First mentioning traffic concerns that exist in the area and location of access for Aaron's Rental. Discussion ensued as to issues regarding a common drive. City Engineer Reel related that the Planning Commission would not have information available showing the common drive going through to North First when giving consideration for requested replat approval. Commissioner Brannen moved, seconded by Commissioner Hardwick that the request be approved with the stipulation that the Planning Commission approve the replat as presented and the development carries one curb cut from T.P.
