98 JAN 14MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: January 14, 1998 4:00 p.m. 4:22 p.m. ATTENDANCE: Acting Chairman Bob Walker Commissioners: Ken Nabors, and B.J. Boroughs PETITIONERS: Variance requested: WhiteCo Outdoor Advertising, Inc. Pizza Pro, Inc. Sign(s) Variance (Chapter 18.76.030 Jax. Mun. Code) __________________________________________________________________ Deputy City Clerk Susan L. Davitt recorded those listed above in attendance and Acting Chairman Walker declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boroughs moved, seconded by Commissioner Nabors that the minutes of the Board of Adjustment Meeting of December 10, 1997 be APPROVED. MOTION CARRIED. VARIANCE REQUEST: WhiteCo Outdoor Advertising, Inc. City Engineer Reel related that WhiteCo, Inc. desires to place three billboards along the east and west sides of Hwy 67/167 near what is known as the "bean field". He further explained that the distance portion of the request is for five hundred (500) feet intervals and the requested height is for fifty (50) feet. He presented the Board with a drawing which diagramed existing signage and the location of proposed signage. Concerns regarding the two hundred fifty (250) foot line perpendicular to offset the required distance was voiced by Acting Chairman Walker. Existing signage was discussed and it was noted that the right-of-way is one hundred twenty (120) to one hundred thirty (130) feet which is the reason for the variance of existing signs. Commissioner Boroughs moved, seconded by Commissioner Nabors to allow two signs for West side of Hwy 67/167 with a distance of 1,000 feet each and to split the difference between the two existing signs on the east side for sign location. MOTION CARRIED. City Engineer Reel related that he did not see a problem with granting the requested increased sign height. He stated that most billboard signs are fifty (50) feet in height and that the sign ordinance which was written some time ago, might account for the set forty-five (45) foot maximum sign height. BOARD OF ADJUSTMENT continued: January 14, 1998 4:05 p.m. 4:22 p.m. Commissioner Nabors moved, seconded by Commissioner Boroughs to approve the height waiver of five (5) feet bringing sign height from forty-five (45) to fifty (50) feet. MOTION CARRIED. VARIANCE REQUEST: Pizza Pro, Inc. This item of business was first introduced to the Board of Adjustment December 10, 1997, at which time it was tabled until 17 December 1997 pending input from the office of the City Attorney. The Board met on the 17 of December but was unable due to the lack of quorum to conduct business. It was decided that the Board would handle the request again on January 14, 1998 at the next scheduled meeting. Acting Chairman Walker reviewed the history of the request and pictures of the proposed signage were viewed by the members along with a list of recommendations from City Attorney Robert Bamburg. RECOMMENDATION FOR THE CITY ATTORNEY 1. Sign must be in place no longer than thirty (30) days and no less than fourteen (14) days. 2. Each location must meet with regulation regarding sign placement as directed by the Code Enforcement Department or City Engineer. 3. Each new location will require a new sign permit obtained with approval from the Code Enforcement Department or City Engineer. 4. Sign must be located with the front edge no closer than eight (8) feet to the front property line and be anchored so that it is not mobile while on location. 5. A letter of permission from the property owner must be presented to the proper authority prior to a sign permit being obtained. Commissioner Boroughs moved, seconded by Commissioner Nabors that the request be granted contingent on recommendation from the City Attorney being met. MOTION CARRIED. Commissioner Nabors moved, seconded by Commissioner Boroughs to adjourn the meeting at approximately 4:20 p.m. MOTION CARRIED.
