97 SEP 10MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: September 10, 1997 4:05 p.m. 4:15 p.m. ATTENDANCE: Acting Chairman John Hardwick Commissioners: Ken Nabors, B.J. Boroughs, and Mark Perry PETITIONERS: 39 Wright Circle/William McCutcheon, Jr. Variance requested: Front Yard Encroachment (Chapter 18.68.050 Jax. Mun. Code) __________________________________________________________________ Deputy City Clerk Susan L. Davitt recorded those listed above in attendance and Acting Chairman Hardwick declared a quorum. VARIANCE REQUEST: 39 Wright Circle/Front Yard Encroachment (Ch. 18.68.050 Jax. Mun. Code) Acting Chairman Hardwick called the meeting to order and introduced the item of business. He invited Mrs. McCutcheon to address the Board. Mrs. McCutcheon related that the request for a front porch is mainly due to the need of shading the front of the home and improve the look of the residence. She explained that the afternoon sun which shines directly onto the front of the home makes the door too hot to touch. In response to a questioned posed by the Chairman, Mrs. McCutcheon related that there is no existing porch. It was noted that the fire place is flush with the building setback line. Commissioner Boroughs cited a similar situation where a home received sun damage, melting the plastic inserts around the front door. It was noted that the property was properly posted and that there had been no input from surrounding neighbors. Acting Chairman Hardwick stated that the variance was approximately 4 ft. variance. The petitioner explained that the roof would be attached to the house and be supported by three post in the front, noting that both ends of the porch would be open. Discussion ensued as to any protrusive to the building lines such as fireplaces in front or side yard setback. City Engineer Reel stated that it depends on whether a structure obliterates view as to how the Bill of Assurance addresses structures such as porches and the building line. BOARD OF ADJUSTMENT continued: September 10, 1997 4:05 p.m. 4:15 p.m. Commissioner Boroughs moved, seconded by Commissioner Nabors to approve the building line Encroachment variance at 39 Wright Circle. MOTION CARRIED. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Perry moved, seconded by Commissioner Nabors that the minutes of the Board of Adjustment Meeting of June 11, 1997 be APPROVED.
