APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Boroughs moved, seconded by Commissioner Patton that the minutes of the Board of Adjustment Meeting of April 10, 1996 be APPROVED. MOTION CARRIED.
VARIANCE REQUEST: BETHEL BAPTIST CHURCH
Acting Chairman Reid related that Bethel Baptist Church is seeking three variances: (1) a side yard waiver from 15 ft. to 12 ft., (2) a rear yard waiver from 20 ft. to 12 ft., and (3)
a parking waiver. All three waivers as requested are in violation of Section 18.68.050 of the Jacksonville Municipal Code.
Discussion ensued as to the location of property where owners have granted use to the church for overflow parking. Mrs. Hall related that the letter of permission from Billy Hall referred
to property located around Pam's Place and the Hair Loft. It was noted that a letter of permission received from Mr. Phil Keaton referred to the lot on Jeff Davis which backs up to
212 North James Street. Mrs. Hall related that the church is currently looking at purchasing part of the land adjacent to the church for overflow parking.
Pastor Gary L. Wise related that the proposed construction is for a 100' by 160' all purpose building which is to be used as a sanctuary and later be bricked as the church can afford.
Commissioner Boroughs pointed out that there seems to be no opposition to the requests and since the Halls own the adjoining property and have no objection to it being used for overflow
parking, he does not foresee a problem with the parking request.
City Engineer Reel related that the ordinance requires one parking space per every four pews. He related that the proposed construction was able to provide for fifty spaces and that

parking granted to the church would more than give them the seventy-five required spaces. He then related that there are eighteen parking spaces on the church lot itself that can be
utilized because of the 35' front yard setback, adding that lot one is vacant and can provide 30 or 40 more parking spaces. He then related that property already owned by the church
can provide the necessary seventy-five spaces under the new layout submitted.
Discussion ensued as to options regarding the side yard setback if the properties could be joined as one piece of property.
City Engineer Reel related that the setback waiver requests are for the west property line (west end of the proposed building) and the south side of the proposed building. It was concluded
that fire codes prevented them from shifting the proposed construction toward the east.
It was pointed out by Commissioner Boroughs that the property was properly posted and has attracted no opposition to the requests.
City Engineer Reel informed the petitioners that before applying for the building permit they would need to meet with the Fire Marshal, Charlie Pope, regarding fire codes and building
distances. In response to a question posed by City Engineer Reel, it was related that a fire hydrant was located on church property.
Commissioner Boroughs moved, seconded by Patton to approve the variance for the requested side and rear yard setbacks and a waiver for the parking requirements. MOTION CARRIED.
