96 MAR 27MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: March 27, 1996 4:00 p.m. 4:10 p.m. ATTENDANCE: Commissioners: Chairman Art Brannen, Commissioners Larry Baldwin and Rudy Reid / City Engineer Duane Reel represented the City of Jacksonville. PETITIONERS: (1) Andy West Variance requested: Side Yard Setback Variance of 5' 2500 T.P. White Drive (Chapter 18.60.030 Jax. Mun. Code) (2) J.C. James Variance requested: C-2 Conditional Use in an M-2 zone (gen. location/GTE Bldg. West Main St.) __________________________________________________________________ City Clerk Lula M. Leonard recorded those listed above in attendance and Chairman Brannen declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Reid moved, seconded by Commissioner Baldwin that the minutes of the Board of Adjustment Meeting of March 13, 1996 be APPROVED. MOTION CARRIED. VARIANCE REQUEST: ANDY WEST / VARIANCE FOR A SIDE YARD SETBACK OF 5' REQUESTED (violation of Chapter 18.68.050 of the Jacksonville Municipal Code) Mr. West explained that parking for apartments will make it difficult with regard to entry and exit for customers of his proposed Auto Repair Glass Shop. The open field adjoining the parcel was noted to be zoned C-1. He related that owners of said property have voiced no opposition to the 5' variance request. City Engineer Reel pointed out that Fire Code requirements (a 1-hour fire wall) are met in the proposed metal building to be constructed of non-combustible materials. He said that the City has no problem with the request. He noted that there has been discussion with regard to making changes in the Municipal Code with regard to setback requirements relating to commercial construction, mentioning the expense of said property, if and when fire code requirements are met. He pointed out that at Johnson Plaza zero clearance was granted. MINUTES MARCH 27, 1996 BOARD OF ADJUSTMENT continued: Commissioner Reid moved, seconded by Commissioner Baldwin that the variance request of Mr. Andy West for a 5' side yard setback with regard to construction at 2500 T.P. White Drive be APPROVED. MOTION CARRIED. (2) MR J.C. JAMES / C-2 CONDITIONAL USE IN M-2 ZONE Chairman Brannen read a list of things allowed in M-2 and C-2 zones as listed in the Jacksonville Municipal Code. Mr. James related that the Department of Human Services desires to construct a 30-unit office building if approval is given by the Board of Adjustment. Mr. & Mrs. Richard Ashenberger attended the meeting and presented questions relating to the proposed office complex and its effect on their property which adjoins the parcel on which the office building will be located. City Engineer Reel explained that a parking area is allowed under power lines, but that a structure may not be placed under the power lines or on an easement. Mr. Ashenberger voiced questions related to building design. He was informed by Chairman Brannen that questions so related would be dealt with at the time a building permit is presented to the Jacksonville Planning Commission. Commissioner Baldwin moved, seconded by Commissioner Reid that the request made by Mr. J.C. James for a C-2 conditional use in an M-2 zone be APPROVED. MOTION CARRIED.
