95 JUN 07MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: June 7, 1995 4:00 p.m. 4:13 p.m. ATTENDANCE: Commissioners: B. J. Boroughs, Rudy Reid and Larry Baldwin Code Engineer Duane Reel City Attorney Robert Bamburg represented the City of Jacksonville PETITIONER: J. C. George and Dave Goins Variance requested: Conditional Use Grant of a Child Care Facility in an M-2 zone. As set forth in the Jacksonville Municipal Code section 18.08.241. __________________________________________________________________ Deputy City Clerk Susan L. Davitt recorded those listed above in attendance and Acting Chairman Reid declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boroughs moved, seconded by Commissioner Baldwin that the minutes of the Board of Adjustment Meetings of March 22, April 26, and May 24, 1995 be APPROVED. MOTION CARRIED. Acting Chairman Reid voiced the request for a conditional use of a Child Care Facility in an M-2 zone. He read from Ordinance 1045, passed by the City Council June 1, 1995 regarding permitted zoning classifications and conditional uses. Discussion ensued as to procedure of change for a zone conditional use and the Board of Adjustment's authority to grant conditional uses as outlined by the Ordinance. It was disclosed by City Attorney Bamburg that the different zoning classifications of the Jacksonville Municipal Code do not address child care facilities and that there would be more changes coming from the Planning Commission for presentation to the City Council for adoption and amendment of the Code. He then related that the issues of day care have not been updated since 1968. Acting Chairman Reid related that a lot of businesses today offer child care for their employees. He stated that he noticed a Head Start Office in the area of where the request is being sought. It was discussed that with regard to safety issues, Pathfinders Inc. would have the area around the day care fenced. BOARD OF ADJUSTMENT continued: June 7, 1995 Commissioner Boroughs moved, seconded by Commissioner Baldwin that the request for a conditional use of a day care facility at the AGL Building be granted.
