MINUTES: BOARD OF ADJUSTMENT
DATE AND TIME: July 14, 1993 4:00 p.m.- 4:10 p.m.
ATTENDANCE: Commissioners: Chairman Brannen,

City Engineer Duane Reel represented the
City of Jacksonville
PETITIONER: Pathfinder Inc.
Variance Requested: Building setback requirements and Parking
space requirements.
Location: Lots 4, 5, 6, 7, and 8 West Jacksonville
Subdivision, Mulberry Street.

Deputy City Clerk Susan Goings recorded those listed above in
attendance and Chairman Brannen called the meeting to order. A
quorum was present.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Patton moved, seconded by Commissioner Boroughs that
the minutes of the Board of Adjustment meeting of June 23, 1993 be
APPROVED. MOTION CARRIED.
Chairman Brannen introduced the request for a variance as submitted
by the petitioner, Pathfinder Incorporated.
Chairman Brannen related that lots 5, 7, and 8 are zoned C-2, while
lots 4 and 6 are zoned R-4; adding that the guide lines would be
for residential zoning requirements, which stipulates a 35 ft.
front yard setback and 25 ft. back yard setback. He stated that
the request by the petitioner is for a 28 ft. front yard setback
and a 20 ft. back yard setback with 15 ft. side setbacks. He
further related the request to waive the parking requirements from
1 1/2 spaces to 1 space per unit, noting that the proposed
residents do not drive.
It was related by both Commissioner Boroughs and City Engineer Reel
that this type of construction rarely has any vehicles on the
property.
In response to a question from Commissioner Boroughs regarding
corner lot setbacks, City Engineer Reel related that subdivision
regulations were established to lend a more spacious appearance
within subdivisions, adding that a lesser setback has not as yet
presented a problem with visibility. It was noted by City Engineer
Reel that the proposed side yard setbacks meet with the zoned
requirements. He then related that the primary direction the
building faces is considered the front yard setback.

Chairman Brannen related that all entrances for the proposed
construction would be from Mulberry Street.
Commissioner Boroughs commented that he felt the completed
construction will be an improvement to the area.
Commissioner Boroughs moved, seconded by Commissioner Patton to
grant the requested setback variances and waive the parking
requirements for lots 4, 5, 6, 7, and 8, Block 7, West Jacksonville
Subdivision, Mulberry Street. MOTION CARRIED.
ADJOURNMENT:
Chairman Brannen adjourned the meeting at approximately 4:10 p.m.
