20 SEP 14CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPTEMBER 14, 2020 7:00 P.M. – 7:08 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on September 14, 2020. Chairman Stroud opened the meeting at approximately 7:00 p.m. expressing appreciation to those in attendance. Chairman Stroud offered the invocation. Others present on Zoom for the meeting were Public Works Director Jim Oakley, City Attorney Friedman, Engineering Tech Mylissa Griggs, Petitioner Representative Aaron Robinson of Bond Engineering. Chairman Stroud delivered the invocation and welcomed Council Member Mike Dietz as the new Planning Commissioner serving from the City Council. He spoke of Council Member Dietz professional knowledge of the City and the great asset that he would be for the Planning Commission. ROLL CALL: Commissioners William Montgomery, Mike Dietz, Billy Hall, Vivian Brittenum, and Jeff Twitty answered ROLL CALL. Chairman Mark Stroud also answered roll call and declared a quorum. PRESENT (5), ABSENT (2). One seat open. CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Brittenum moved, seconded by Commissioner Twitty to approve the minutes of the rescheduled August 20, 2020 meeting. MOTION CARRIED. DEVIATION AGENDA: REQUEST TO APPROVE PLAT(S): PRELIMINARY PLAT: Notting Hill Subdivision PH I Mr. Aaron Robinson of Bond Engineering presented phase I of Notting Hill Subdivision formerly submitted as Sam’s Settlement. He explained that the water and sewer designs have been submitted to those perspective departments, followed by submittal to the Health Department. He related that this property was part of a land swap with the City of Sherwood and was not formerly zoned when brought into the City of Jacksonville. He stated that the owner is requesting that the property be accepted as an R-1, adding that is how the plat was developed. Commissioner Montgomery noted that the property has one entrance and exit. Discussion ensued as to being sufficient once both phases are developed out. Engineering Tech. Mylissa Griggs related that they had conducted a planning meeting regarding Sam’s Settlement, explaining that the property was not annexed with a zoning. She stated that the City does not have a problem with the property being zoned as R-1 as stated on the plat. Mr. Robinson acknowledged that one request was to widen the entrance and street to 35’ and that has been done. He then noted that there are 35 lots in phase one with a total of 80 lots when the Subdivision is totally completed. He stated that this development would be similar to the Base Meadows Subdivision, adding that the lot widths and depth would not change. He noted a 50’ right-of-way with all utilities in the easements. He related that when originally presented as Sam’s Settlement as a sketch plat it had one entrance and exit which is what is planned for both phases I and II. He then noted that phase II would have a turnaround, which is okay with the Fire Marshal. Council Member Dietz moved, seconded by Commissioner Hall approve the preliminary plat for Notting Hill Subdivision PH I granting the request for the property to come into the City as an R-1 and contingent that the entrance and street be 35’. MOTION CARRIED. RESUME AGENDA: PUBLIC HEARING(S): REZONING 517 Gregory Street R-3 to C-3 Petitioner Joe Douglas Chairman Stroud opened the public hearing at approximately 7:13 p.m. Mr. Douglass explained that the Highway Department is proposing to construct an overpass and his property consists of two lots located between duplexes to the west and Pepitos Restaurant to the east. He stated that one of the lots is zone C-3 and the other is zoned R-3, adding that the because of the Highway Department’s plans he is going to lose two driveways because they will be too close to the intersection. He stated the Gregory Street Overpass will render his C-3 lot useless, due to a lack of access. He related that the R-3 lot is adjacent on the north to Gregory Street, on the east by the C-3 lot, on the south by Best Western Hotel, and on the west by the back yard of two duplexes. He explained that rezoning the lot from R-3 to C-3 would provide access, which may occupy the landlocked lot, with a driveway across the lot on which the rezoning is being requested. With no one to speak in opposition, Chairman Stroud closed the public hearing at approximately 7:15 p.m. Council Member Dietz stated that the rezoning would make sense noting that it would make the area and the lots more useable. Commissioner Hall moved, seconded by Commissioner Montgomery to approve the rezoning of 517 Gregory Street from R-3 to Commission-3 as requested. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): PRELIMINARY PLAT: Notting Hill Subdivision PH I Addressed under Deviation in agenda. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING SEPTEMBER 14, 2020 7:00 P.M. – 7:23 P.M. In response to a question from Commissioner Twitty, Ms. Griggs answered that the minimum square footage for the homes in Notting Hill Subdivision would 1400 square feet.
