20 MAY 21CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING MAY 21, 2020 6:30 P.M. – 6:46 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on May 21, 2020. Chairman Stroud opened the meeting at approximately 6:30 p.m. expressing appreciation to those in attendance. Chairman Stroud offered the invocation. ROLL CALL: Commissioners William Montgomery, Gary Sipes, Vivian Brittenum, Jeff Twitty, and Greg Bollen answered ROLL CALL. Chairman Mark Stroud also answered roll call and declared a quorum. PRESENT (6), ABSENT (2). Others present for the meeting were Public Works Director Jim Oakley. Randy Jones representing First Electric Cooperative. CORRECTION AND/OR APPROVAL OF MINUTES: Council Member Sipes moved, seconded by Commissioner Twitty to approve the minutes of the regularly scheduled March 9, 2020 meeting and the rescheduled meeting minutes of April 23, 2020. MOTION CARRIED. PUBLIC HEARING(S): REZONING property on North First Street from C-1 to C-2 for retail outlet Chairman Stroud opened the public hearing at approximately 6:34 p.m. Mr. Randy Jones representative for First Electric Cooperative related that they have a buyer for the 1-acre site regarding a parcel owned by First Electric Cooperative. He then noted that the parcel is adjacent to the old First Electric office complex. He related that the parcel total is 4 acres and they are subdividing 1 acre for a retail sales outlet. He pointed out that Tract A will become a shared driveway for this lot and any future lots that might develop after this sale. He then assured the Planning Commission that they are aware they would have to return to the Planning Commission regarding any future plans for the remaining 3 acres. He then offered that First Electric will jointly share in the construction cost of the shared driveway with the owner of lot 1. He emphasized that there would only be one driveway for the four 1-acre lots. Public Works Director Jim Oakley stated that the rezoning and subdividing is all in order. With no one to speak in opposition, Chairman Stroud closed the public hearing at approximately 6:37 p.m. Commissioner Montgomery questioned if the shop to the rear would be separate from this property. Mr. Jones related that the 4-acre parcel is vacant but adjacent to the building. He then added that First Electric no longer owns the other property that served as their headquarters. He then answered that he is not aware of the current owner of the property with their former CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING MAY 21, 2020 6:30 P.M. – 6:46 P.M. offices but noted that they sold the property to a company called Utility Support Systems but they have since changed their name since they were bought out by another company. He related that they own the parcel within the fence and previously sold the parcel for the auto parts store. He then stated that he is not sure of the property that the cell tower is located on. In response to a question from Council Member Sipes, Mr. Jones stated that there is a confidentiality agreement with the proposed buyer regarding exactly what retail establishment will locate there. He then offered that to his understanding it would be something similar to a Dollar Store or a Dollar General. Commissioner Twitty moved, seconded by Council Member Sipes to approve the rezoning from C-1 to C-2 as requested by First Electric Coop. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): FINAL PLAT CBC Real Estate Subdivision, Lot 1 on North First Street Public Works Director Jim Oakley confirmed that it would be a shared access for all four lots, adding that he recommends the shared driveway because it would limit having to have multiple accesses onto a four-lane highway with two-way left turns, saying that it would be the safest design to have a common shared drive. Mr. Jones stated that their agreement with the buyer is that they would construct the driveway to Jacksonville street standards, even though it will be a private drive. He added that they are in favor of that because First Electric will be responsible for fifty percent of the maintenance costs as long as they own any of the remaining parcel. He then added that it is First Electric’s intention to sell the remaining property and as that happens Tract A will be an undivided interest with all the land owners of the four aces. He stated that the ownership and maintenance of the common drive would be shared among the owners of any tracts further divided. Public Works Director Jim Oakley then answered Chairman Stroud that there is already a sidewalk on the property. He then added that when the building permit is issued, the Engineering Department will ensure that it meets with the landscaping requirements. Mr. Jones noted that one good aspect of the property developing is that it will correct some drainage issues that were previously installed by First Electric approximately 15 to 20 years ago. He explained that it actually drains to the subdivision to the west, noting that the drop inlets do not have any caps because they were not sure what grade to put them on. He stated that one of the drop inlets will be in the shared drive so it will be covered and done properly CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING MAY 21, 2020 6:30 P.M. – 6:46 P.M. when this development occurs. He related that the drainage from the adjacent subdivision actually flowed across First Electric’s property and First Electric installed the current drainage design. He stated that he believes it is a 22 or 30-inch pipe, a fairly substantial drainage project they installed but they did not install caps without knowing the grade until they had a site plan. He stated that one of the drainage structures would be involved in the development of this property. Council Member Sipes moved, seconded by Commissioner Twitty to approve the Final Plat of CBC Real Estate Subdivision, Lot 1 on North First Street. MOTION CARRIED.
