20 APR 23 rescheduledCITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING APRIL 23, 2020 6:30 P.M. – 7:10 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on April 23, 2020. Chairman Stroud opened the meeting at approximately 6:30 p.m. expressing appreciation to those in attendance. Chairman Stroud offered the invocation. ROLL CALL: Commissioners Gary Sipes, Billy Hall, Vivian Brittenum, Jeff Twitty, Dan Brown, and Greg Bollen answered ROLL CALL. Chairman Mark Stroud also answered roll call and declared a quorum. PRESENT (7), ABSENT (1). Chairman Stroud welcomed new Commissioner Greg Bollen. Others present for the meeting were Public Works Director Jim Oakley. Tommy Bond and Aaron Robinson were on teleconference. CORRECTION AND/OR APPROVAL OF MINUTES: It was announced that the minutes of March 9, 2020 would be available at the next meeting. PUBLIC HEARING(S): REQUEST TO APPROVE PLAT(S): a. SKETCH PLAT Sam’s Settlement Chairman Stroud identified Bond Engineering as representatives for developer Greg Heslep. Mr. Tommy Bond related that originally there were 84 lots, but 2 have been taken out to be used for storm drainage retention. He then added that all of the lots would be serviced by gravity sewer and would have Jacksonville water. He noted that this area was in contention with the City of Sherwood, and the area was turned back to the City of Jacksonville to be a part of Jacksonville. Chairman Stroud confirmed with Mr. Bond that the legal descriptions have been corrected along with other items requested by the Engineering Department. Public Works Director Jim Oakley noted the concern that the Subdivision has only one ingress/egress, saying that it would have been better to have a second road in the vicinity of the retention basin. He questioned Mr. Bond as to the feasibility of making that happen. Mr. Bond stated that he would be willing to try and see if that could be worked out, adding that it would be very difficult because of the lot that is out of the Subdivision and it would be hard to get around that. Public Works Director Jim Oakley stated that he would like to look at that between now and the preliminary plat presentation. Mr. Bond agreed. CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING APRIL 23, 2020 6:30 P.M. – 7:10 P.M. Public Works Director Jim Oakley informed the Planning Commission that this property was a land swap with Sherwood on General Samuels Road. Commissioner Bollen moved, seconded by Commissioner Twitty to approve the sketch plat of Sam’s Settlement as presented. MOTION CARRIED. b. PRELIMINARY PLAT Graham Woods PH 4 Mr. Aaron Robinson of Bond Engineering presented as representative for Ms. Dana Nixon, developer. He stated that phase 4 consists of 93 lots, explaining that it consists of a culdesac and then another road both accessing off Graham Road. He then added that there are a few lots off the back of the phase that are in the flood plain, saying that they would fill the lots to have them removed from the flood plain and then submitted to the Water and Sewer Departments. He noted that those Departments have not had a meeting yet, but they have answered all questions from both Departments. Mr. Robinson answered Chairman Stroud that the flood plain develop permit application is the only outstanding item from Engineering requests, explaining that it cannot be addressed until the construction process begins. He noted that they added the sidewalk along Magnolia Street and are waiting on the Water and Sewer Commissions to meet for their approval. He stated that the concrete ditch was added and the sidewalk will be ADA compliant. He then further noted that the swell details and sidewalk details were changed and the location of the street light was moved. He stated that all the questions have been answered, noting that it is just not discernable on the preliminary plat. Mylissa Griggs, City Engineering Technician, offered that all Engineering concerns have been addressed, agreeing that it is not visible since it is part of the design, which will be monitored along the process of development. She then asked that any approval be contingent upon water and sewer approval. Chairman Stroud answered Commissioner Montgomery that the entire Subdivision has two entrances. Mr. Robinson added that during phase 1, 2, and 3 there were three accesses onto Graham Road and those accesses lead to phase 4 via Westwood Drive. He then explained that Redbud will loop around and connect to Westwood Drive. Chairman Stroud confirmed with Public Works Director Jim Oakley that the culdesac does meet City codes. Commissioner Montgomery moved, seconded by Commissioner Twitty to approve the preliminary plat of Graham Woods PH 4 contingent upon acceptance of the sewer and water from those Departments. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING APRIL 23, 2020 6:30 P.M. – 7:10 P.M. c. FINAL PLAT Site Work One Chairman Stroud noted that the proposed development is on the agenda for not only a final plat but also for a building permit as a one-lot subdivision. He then noted that part of the property is in the flood plain. He recognized Bond Engineering as the representatives for the developer, Robert Waters. Mr. Bond noted that the plat was first initiated and presented to the Planning Commission approximately two years ago, adding that finally all the issues have been worked out. He then related that they are requesting a sidewalk waiver, adding that beyond that, he believes all issues have been agreed upon. In response to a question from Chairman Stroud, Mr. Bond answered that they have filed for a flood plain permit with the County regarding a flood plan fill permit. Public Works Director Jim Oakley noted that the developer is requesting waivers for the sidewalk and dumpster as well as leaving the surface as gravel because of the heavy equipment. He then related that these are general requirements for commercial property. Mr. Bond clarified that the owner has six dumpsters that are used for construction sites and not for business use on this site. He explained that the developer contends that he has little to no waste on this site. Public Works Director Jim Oakley stated that the developer has to find some way to dispose of any garbage generated on site. He then noted that it was his understanding that the developer might bring in other businesses in the future, adding that any waste concerns could be addressed at that time. Mr. Bond stated that he would assume that Mr. Waters would be paying for water, sewer and City garbage billed by the City. Public Works Director Jim Oakley clarified that any commercial business over 4,000 square feet would require private garbage unless it is broken up to be less. He added that it is a possibility, citing that he believes the building will be approximately 7,500 square feet. He then confirmed the plans include landscaping requirements as per City codes. He then assured Chairman Stroud that a permit would not be issued until the developer obtained his flood plain permit, making it a nonissue for the final plat. He then assured Chairman Stroud that if any additional businesses are added at this site, he would readdress the issue of having a dumpster on site. He added that he did not feel this to be a major issue, saying that the sidewalk would be a significant waiver since everyone else is putting in sidewalks generally speaking. He stated that there would be some concrete to CITY OF JACKSONVILLE, ARKANSAS RESCHEDULED PLANNING COMMISSION MEETING APRIL 23, 2020 6:30 P.M. – 7:10 P.M. the front of the building for dust-free parking but would leave the entrance aprons as gravel because of the heavy equipment that would be using the entrance. Mr. Bond stated that with the heavy equipment, paving the aprons would be torn up and it seems like a terrible waste. He then stated that as far as the sidewalk, there is no sidewalk to the north or south of this property to connect onto, noting that once again the heavy equipment will be crossing back and forth. Council Member Sipes moved, seconded by Commissioner Bollen to approve the Final Plat of Site Work One with waivers for the sidewalk and dumpster requirements as well as a waiver to have a gravel drive instead of a hard surface such as concrete contingent that all flood plain permits are approved. MOTION CARRIED. BUILDING PERMIT(S): REVISED SITE PLAN Site Work One Council Member Sipes moved, seconded by Commissioner Twitty to approve the revised site plan for Site Work One pending their obtaining a flood plain permit before the building permit is issued.
