OPENING REMARKS:
The Planning Commission of the City of Jacksonville, Arkansas met in a
special session on November 26, 2019. Chairman Moore opened the
meeting at approximately 5:30 p.m. expressing appreciation to those in
attendance.
ROLL CALL: Commissioners Gary Sipes, Billy Hall, Vivian Brittenum,
Jeff Twitty, Dan Brown, and Mark Stroud answered ROLL CALL. Chairman
Jim Moore also answered roll call and declared a quorum. PRESENT (7),
ABSENT (1).

GENERAL: Recommending to City Council Ordinance 1624 (#31-2019)
AN ORDINANCE AMENDING AND MODIFYING JACKSONVILLE MUNICIPAL CODE
§18.52.020 ALLOWING MICROBREWERIES AS A PERMITTED USE IN C-4 ZONES
WITHIN THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES.
Chairman Moore had City Attorney Friedman read the heading of
Ordinance 1624.
Chairman Moore recalled that the Planning Commission had approved the
microbrewery on the Hwy. going towards Cabot. He then related that a
problem arose and there was no wastewater on the proposed location.
He added that the owner of the microbrewery has decided to locate in a
small shopping center behind Zaxby’s. He then noted that the other
businesses located within the shopping center are Firehouse Subs,
Tropical Smoothie, a vape shop, Edge Reality, Army Recruiting station.
He then advised the Planning Commission that the owner has already
signed the lease to occupy the last two suites on the end at this
location. He concluded saying this would be the recommendation to be
forwarded to the City Council. He referred to the diagram that was
provided, asking for any questions or recommendations. He related that
he is proposing to have shuffleboard, game tables, barber and beauty
shop.
In response to a question from Council Member Sipes, Chairman Moore
answered that the owner is proposing to have a food truck out front in
the parking lot area.
City Attorney Friedman stated that it is with the microbrewery by law.
Chairman Moore stated that while it is a microbrewery, it does not
involve gas, the entire operation is electric. He then answered
Commissioner Twitty that he did not yet have the hours of operation.
He stated that basically the two suites do not have electricity, air
conditioning, heating and plumbing; explaining that they would have to
be installed.

He then answered Commission Twitty that this is a smaller operation
than was originally planned when he was going to located by the
Freeway.
Commissioner Stroud asked for clarification regarding the food truck.
City Attorney Friedman stated that under Act 681 that was passed in
this legislative session, it allows microbreweries to operate in dry
areas but you have to meet extra conditions with the ABC Board. She
continued saying that the first step is for the City to pass an
Ordinance allowing that to happen. She added that the food
requirement is not necessary for the microbrewery, if that answers the
question.
Commissioner Stroud stated that aesthetically what he is looking at is
a nice building but there is going to be a food truck parked out in
front of the building.
Chairman Moore stated that it would be the owner’s food truck that he
will design and develop. He continued saying that he would not be
hiring in food trucks according to our conversations.
Commissioner Twitty stated that he had visited a microbrewery in east
Little Rock but they did have eat-in accommodations.
In response to a question from Commissioner Twitty, Chairman Moore
stated that he does not believe there are any prohibitions regarding
where food trucks can set up. He noted that even snow cone stands are
located in shopping center parking lots. He then related that the food
truck will be at the end of the building in the parking lot, adding
that the owner has calculated and it will fit okay. He then added
that the shopping center owners are agreeable for this type operation.
Commissioner Twitty questioned if this item would require advertising
or hosting a public hearing.
Chairman Moore replied that we do not. He then stated that we have
actually already advertised this microbrewery when we were going to
have it located on the Hwy. and now it is just changing the location.
City Attorney Friedman stated that this Ordinance is not specifically
for this microbrewery, it is just to change the current Code we have.
Council Member Sipes moved, seconded by Commissioner Brittenum to
recommend adoption of Ordinance 1624 to the City Council. MOTION
CARRIED.
Chairman Moore stated that it would probably be January or so because
they will have to do a complete remodel to the suites. He then
related that eventually he will have another plan at one of the
Planning Commission meetings to offer the Commissioners.
